라선경제무역구에 대한 中朝 공동개발 관리체계와 법제도 = The Joint Development Management System and Legal System of China and the DPRK on the Rason Economic and Trade District

다국어 초록 (Multilingual Abstract)

Under the framework of “developing and co-managing the North Korea's Rason Economic and Trade District” between China and the DPRK, the two governments jointly established and operated the “Rason Economic and Trade District Management Committee” as a specific operating agency. The current relevant laws stipulate that the Rason Economic and Trade District Management Committee is “the local administrative authorities that responsible for the management and operation of the industrial zones and specific areas within the Rason Economic and Trade District”. At present, around the operation of Rason Economic and Trade District, the Management Committee has constructed a clear, complete and unique legislative mechanism, and has formulated a large number of principled rules and specific rules. Some rules have already played an active role in practice. However, in general, the legislation is still in the primary and principled legislative stage and has not yet entered the stage of formulation of practical operational rules. The lag of legislation is hindering the economic development of the Rason Economic and Trade District.

在中朝两国 “共同开发, 共同管理朝鲜的罗先经贸区” 机制框架之下, 两国政府共同组建并运行 “罗先经贸区管理委员会” 这一具体操作机构. 现行相关法律对罗先经贸区管理委员会的定位是 “负责管理和运营罗先经贸区内的产业区, 特定区域的当地管理机关”. 目前, 围绕着罗先经贸区的运营, 已形成一个清晰的, 完整的, 独特的立法机制, 并出台了数量不少的原则性规则和具体规则. 有些规则已经在实践中发挥积极作用. 但总体而言, 立法尚处于初级的, 原则性立法阶段, 尚未进入实际操作性规则的制定阶段. 立法的滞后性正在阻碍着罗先经贸区的经济发展.
