방송 프로그램의 제작과 유통 과정에 있어서 저작권 침해에 관한 시론적(試論的) 연구

국문 초록 (Abstract)

?;?;본 논문에서는 방송 저작물의 제작 및 유통과정에 일어날 수 있는 저작권 침해 문제를 검토하는 한편 이 문제에 관한 대응방안의 모색하였다. 방송 저작물에는 다수의 권리자 및 이용자들의 권리관계가 복잡하게 얽혀있어 이로 인한 저작권 침해 문제가 불가피하다. 더욱이 인터넷의 보급의 보편화와 함께 인터넷 상 복제 및 전송이 자유로워짐에 따라 방송저작물의 저작권 침해가 더 한층 손쉬워졌다. 이에 따라 방송저작권보호를 위해 논의되고 있는 것이 기술적 보호조치이다. 국내에서 논의되는 것으로는 PPI 기반의 방송 프로그램 보호신호 송수신시스템 및 단말 플랫폼의 개발과 지상파 방송사가 OSP와의 합의를 통해 특징점(DNA) 기반의 콘텐츠 필터링 기술을 적용하여 사이버 공간에서 유통되는 방송 저작물을 보호하는 것 등이 있다. 아울러 해외의 기술적 보호조치 방안을 살펴보면서 이의 국내 도입 가능성 등을 논의해 보았다.<br/>

다국어 초록 (Multilingual Abstract)

This study reviews problems of copyright infringement that can be occurred in the process of production and distribution of Broadcasting Contents and suggest some solutions about these problems. It is inevitable to arise issues about copyright infringement caused by the fact that multiple people who have rights and users coexist in the Broadcasting Contents. Furthermore, it increases the rate of copyright infringement on Broadcasting Contents as reproduction and transmission became more practicable on the Internet due to the prevalent use of the Internet. For this reason, Technological Protection Measures are cross lips as methods for protection of Copyright Originating from Broadcasting. As the ways to protect it several solutions discussed in the country are as follows. Firstly, exchange subsystem of protective signal for broadcasting programs based on PPI and terminal platform should be developed. Secondly, it is needed to protect Broadcasting Contents distributed in the cyber space by introducing contents-filtering technology based on DNA after consultation between terrestrial broadcasting companies and OSP. In addition to these, whether foreign Technological Protection Measures could be adopted in the country is debated examining them.
