The classification of administrative acts as either binding (non-discretionary) or discretionary constitutes a foundational determination that governs both the scope and intensity of subsequent judicial review. When statutory language employs mandatory terms, courts presume the resulting administrative act to be binding in nature.
Any interpretation characterizing such an act as discretionary demands compelling justification, requiring thorough examination of legislative history, statutory purpose, and the encompassing legal framework within which the provision operates.
A more complex analytical question emerges regarding whether general principles of law—particularly proportionality—may be invoked even after a binding administrative act has been properly interpreted and lawfully applied. German jurisprudence continues to grapple with this issue, reflecting ongoing scholarly and judicial debate. In the Korean legal system, I argue that courts not only may but must invoke constitutional principles when binding administrative acts infringe upon fundamental rights, thereby ensuring the preservation of constitutional integrity and supremacy.
While both proportionality and the principle of legitimate expectations require courts to balance competing public and private interests, these doctrines protect different categories of private interests.
The conceptual distinction proves essential for the precise and appropriate application of each principle, preventing doctrinal confusion and ensuring that courts employ the most suitable analytical framework for the specific legal issues presented.
