개신교회 담임목사의 법적 지위에 관한 연구

국문 초록 (Abstract)

우리나라 개신교회의 대다수는 장로정체를 취하고 있다. 이 장로정체는 지교회와 그 상급 단체인 노회, 그리고 그 상급 단체이면서 최고 기관인 총회로 구성된다. 그런데 이러한 기관들은 상하관계에 있지만 각기 독립된 권리능력 없는 사단이다. 지교회의 담임목사는 지교회의 청빙과 노회의 위임을 통하여 선임된다. 이렇게 선임된 담임목사는 지교회의 대표이면서 또한 노회 및 총회의 구성원이라는 이중적인 지위를 가지고 있다. 담임목사와 지교회 사이에는 담임목사를 수임인으로, 지교회를 위임인으로 하는 위임계약이 성립한다고 보는 것이 타당하다. 따라서 지교회는 언제든 위임계약을 해지하여 담임목사를 해임할 수 있다. 지교회에 분쟁이 발생하였을 경우, 지교회는 분쟁을 조기에 수습하는 방법의 하나로 담임목사의 해임을 고려할 수 있을 것이다.

다국어 초록 (Multilingual Abstract)

The majority of Protestant churches in Korea are presbyterian polity. Each local church is governed by the session; groups of local churches are governed by the presbytery; presbyteries join together in a general assembly. However, each of these institutions is an independent association without legal capacity. The senior pastor of the local church is appointed through the call of the local church and the installation of the presbytery. The senior pastor appointed in this way has the dual status of being the representative of the local church and also a member of the presbytery and general assembly. It is reasonable to view that a mandate contract is established between the senior pastor as the mandatory and the local church as the mandator. Therefore, the local church may terminate the mandate contract at any time and dismiss the senior pastor. When a dispute arises in a local church, the local church may consider dismissing the pastor as one of the ways to settle the dispute early.
