지적재산권 보호수준의 결정요인에 관한 탐색 -TRIPS협약과 제도요인을 중심으로- = Determinants of Intellectual Property Protection: TRIPS and Institutional Capacity

This paper explores determinants of intellectual property protection(IPP). Among various factors, we examine whether TRIPS agreement have increased IPP with controlling for other domestic factors such as income level, education, and technology. In particular, we test the relationship between TRIPS agreement and IPP could be moderated by institutional capacity. Analyzing panel data using software piracy rate, World Governance Indicator, and web-based country level data, we found that TRIPS has a significant effect of increasing IPP, but income level also has a reverse U relationship with IPP. Especially, institutional capacity conducted the role of a moderating variable that strengthening the effect of TRIPS agreement. This study suggests that assisting developing countries with regard to enhancing institutional capacity could be a feasible and less-conflictive strategy for IPP under current TRIPS agreement regime.
