환경법의 계보학 ― 환경법제정 60주년을 기념하며 ― = The Genealogy of Environmental Law - Celebrating the 60th Anniversary of Environmental Law -

국문 초록 (Abstract)

환경법은 존재 그 자체가 역설이다. 그럼에도 불구하고 우리의 환경법은 지난 60년 동안 눈부신 성장을 이루어냈다.
이 글은 환경법 제정 60주년을 기념하며 계보학적 방법론을 통하여 우리 환경법의 탄생과 생존･성장, 그리고 그 전망을 논의한다. 환경법의 여건은 그에 결코 우호적이지 않았음에도 이 땅의 환경법은 탄생했고 지속적으로 생존･발전해왔다. 그리고 이제는 누구도 환경가치의 중요성을 부정하지 않게 되었다. 그렇다면 그 원인과 동력은 무엇이며, 나아가 미래의 전망은 어떠할까? 나아가 환경은 지고지순의 가치로 자리매김할 수 있을까? 우리의 논의는 이 사회가 다양한 가치와 가치판단방식 중 어떤 하나를 선택하는 방식으로 자유민주주의를 채택하고 있음을 다시 상기시켜 준다. 이는 곧 환경법의 미래는 결국 우리나라의 제반 조건과 우리 국민의 의식에 달려 있음을 의미한다.

다국어 초록 (Multilingual Abstract)

This thesis examines the life of environmental law in a multifaceted and empirical manner through a genealogical methodology. As a result, it reminds the fact that our society adopts liberal democracy as a way of judging various values. Environmental law is a paradox in its very existence. Nevertheless, our system of environmental law has grown remarkably over the past 60 years.
This article celebrates the 60th anniversary of environmental law and discusses its birth, survival, growth, and future prospects through a genealogical methodology. Although the circumstances were not favourable, the environmental law system has survived and developed, and no one denies the importance of environmental values. But what are its causes and drivers, and what are its future prospects? Furthermore, can the environment become an overarching value? It reminds us that our society adopts liberal democracy as a way of choosing among various values and valuations. This means that the future of environmental law is ultimately depends on the circumstances of our country and the consciousness of the people.
