지식재산의 적절한 보호와 데이터 활용 촉진의 조화에 관한 연구 = A study on the harmonization of the proper protection of IP and use of data

국문 초록 (Abstract)

초연결이 강조되는 4차 산업혁명시데, 데이터를 체계적으로 구축하고 활용하는 데이터사이언스에 대한 관심이 커지고 있다. 데이터 기술 적용의 결과물인 데이터베이스를 구축하는데 요구되는 노력을 보호하는 것이 중요한 한편 이에 대한 활용을 활성화하는 것 역시 간과할 수 없음은 분명하다. 데이터베이스 구축 노력에 대한 보호를 위한 각국의 노력과 우리나라의 현황과 최근 판례를 살펴보고 보호에 공백이 있는지, 있다면 이를 개선하기 위한 방안은 없는지 검토하였다. 보호와 활용 활성화의 조화를 위하여 기존 법률로 보호되는 데이터의 대상과 보호의 예외에 대하여 살펴보았다. 구체적으로는 저작권법과 개인정보보호법 관점에서 데이터의 보호와 IT, 바이오 산업의 성장 관점에서 데이터의 보호 완화에 대한 최근 논의를 검토하고 시사점을 도출하였다.

다국어 초록 (Multilingual Abstract)

With the occurrence of the technological convergence and hyperconnectivity phenomenon of the machines, the data regarding these matters are increasing and more interest has been attracted to the big data technology that could systematically construct and use these data. It is not only important to protect the efforts to construct the database that results from the applied big data technology but it is also important in revitalizing these uses.
In this paper, each country’s works in protecting the efforts to construct the database and also South Korea’s current state and the latest precedents will be reviewed. Through this, it will exam whether South Korea has any gaps in its protection and if there is a gap, whether there are any possible measures to improve this matter. To harmonize between the protection and the revitalizing uses, it will also examine whether there are any exceptions to the data object and its protection under the preexisting law.
More specifically, latest debate on data protection and growth of the bio-industry under the view of Copyright Law and Personal Information Protection Act and relaxing the protection of data under the view of Fair Trade Law will be considered and implications will be deduced from these issues.
