중국 부동산등기제도의 법리 = A Study in the Real Estate Registration in China

다국어 초록 (Multilingual Abstract)

Korea is trading with China frequently. Many Korean human and material resources is going into the China. China passed the law of reality recently, and enforced it October 1, 2007. It is important that we study the real estate registration in china. China has social system and legal culture that are different with korea, and his history is very perpetual, so the Chinese real estate registration has specific characters that are different with korea.
There are recording system and torrens system about registration in Anglo-American law. Registration is needed to form right alteration or to claim it. Registration examiner can inspect it formally or substantially. In China, registration is torrens system, needed to form right alteration, and registration examiners inspect it formally and substantially.
The real estate registration is a public announcement of acquisitions, losses, changes about a real right. Therefore, a public announcement of a real right is a important principle of a real right law. it is same in China, even if the country emphasize on the administration of real estate registration. Especially, we have to study on the public trust of it. This paper demonstrates a present state, problems and solutions of the real estate registration in China.
