한반도 평화체제의 재해석: “사실상의 평화”라는 시각에서 = The Reinterpretation on the Korean Peninsula Peace Regime : In the Perspective of the “De Facto Peace”

다국어 초록 (Multilingual Abstract)

The Korean Peninsula Peace Regime(KPPR) have been mainly discussed on the focus of the ‘de jure peace’, peace agreement. But ‘de jure peace’ could be possible and durable with the ``de facto peace`` including the following issue; confidence-building process, developments of the relationship, the change of the mutual recognition etc. Peace Agreement is no guarantee of peace. It is important to make concrete the ambiguity of sensitive issue in the agreement by the efforts of peace-making. On the ‘who would be entitled to participate in negotiating the establishment of KPPR’, the parties to an agreement have been changed by the development of actual relationship between two Koreas. And this article attempts to re-evaluate the meanings of the Declaration of the End of the Korean war. The contents of the declaration may be simple, but the effect can be more complicated. Especially, the declaration might lead to the dissolution of the UN Command. The real effects by the changes from the ‘cease-fire regime’ to the ‘ending war regime’ in Korean Peninsula are more important than the legal force.
