수형자 사회복귀 전환관리에 관한 연구 = The study on the transitional management for the reentry of prisoners within society

다국어 초록 (Multilingual Abstract)

The first article of "The Law on Execution of Sentence and Treatment for Inmate" is to promote the reformation of inmates and their wholesome reentry to society and its ideologic social reentry has been succeeded as always, whereas it tends to be strengthened as time passes.
After considering all these ideologies, all kinds of treatments should be implemented in the direction of assisting inmates' social return except for the inevitably minimum deprivation of freedom to keep order and safety in the correctional institution.
Therefore, because the social return ideology should be adopted on the whole process of execution of sentence, classification review on the beginning of term, including prison industry, correctional education even investigation and disciplinary punishment subsequent to the breach of regulation, all treatments also should be done in view of promoting their social returns.
When it comes to think the word 'correction' in a broad sense, not only divergent treatments running in correctional institutions, but also a series of reentry process including community, family, employment after release are all involved together.
Lately, from the period of preparatory time for returning to society in correctional institution, to assisting social returning settlement after release, western society has reinforced intensified preparatory social return support with revolving around the transition.
In this thesis, the transitional management which assigning offenders to private social welfare agency in Germany, the transitional one through NOMS(National Offender Management System), which was created by combining parts of the National Probation Service and Her Majesty's Prison Service in England and the TPC Project by transitional management in US are introduced detailedly.
On the basis of foreign precedent, we suggested that Korea Correctional Service, the department of Crime Protection and Korea Rehabilitation Agency should be working together for the project.
But it is urgent that Korea should establish a consolidated 'Correction and Probation Agency' which implementing coherent and effective transitional management policy in the long run.

국문 초록 (Abstract)

2천 년대 들어 교정행정 분야 선진국들은 출소자 재범방지에 있어 교도소에서 사회로 복귀하는 전환 과정의 중요성을 인식하고 국가와 민간이 협력하여 성공적 사회 정착 프로그램을 시범 시행하거나 나아가 관련 입법과 조직 정비, 과감한 예산 투입을 통하여 사회복귀를 촉진하는 정책을 매우 적극적으로 확대하고 있다. 우리나라도 비교적 최근 수년 전부터 사회적응훈련원과 출소 전 중간처우의 집을 통해 가석방예정 수용자에 대하여 집중적인 사회적응 준비 프로그램을 시행하고 일부 재범 고위험군 수용자들에 대하여 교정교육 심리치료와 사회복귀 지원 시스템을 가동하는 등 사회복귀 준비단계의 중요성을 인식하기 시작했다. 그러나 아직 현재의 교정과 보호 업무가 서로 상이한 조직 체계로 관리되고 비교적 일부에 불과한 가석방자에 대한 보호관찰, 임의적 갱생보호 체제, 미흡한 사회복귀 예산으로는 전환관리와 사회복귀 성과를 획기적으로 개선해 내기에는 내재적 한계를 안고 있다. 이러한 시점에서 여전히 제기되는 재범에 대한 국민의 불안과 불만에 대응하여 획기적으로 효과 높은 재범예방정책을 수립 시행하기 위해서는 최근선진국의 전환관리 프로그램을 우리 현실에 맞게 벤치마킹할 필요가 있다. 전환관리 프로그램은 우선 교정시설 단계에서 지역사회 교정으로 이어지는 석방 전후 일정 기간 동안 재범 위험자를 우선 대상으로 민간과 협력하여 취업지원 및 신용관리, 주거확보, 가족관계 회복 및 역할 능력 강화, 건강과 인성, 사회적 태도와 관계 등 5개 분야를 집중 점검·지원할 필요가 있다. 또한 재범 위험군에 대한 지역사회 교정 체계를 강화하기 위해 가석방 및 보호관찰 대상이 확대되어야 하며, 보호관찰 대상자에 대한 필요적 갱생보호 제도를 도입하고 민간 운영 출소자 중간처우의 집을 획기적으로 확대 설립하기 위한 장려 정책이 필요하다. 이러한 일련의 패러다임 변화를 위해서 단기적으로는 교정과 보호기관 간 협력팀을 구성 운영하는 등 연계강화 방안이 필요하지만 영국과 같이 결국 단일 조직으로 통합하는 방안이 궁극적인 해결책일 것이다
