도시관리계획에서 전략환경평가 및 사전환경성검토제도의 공법적 고찰

국문 초록 (Abstract)

도시·군관리계획 수립절차상 국토계획법상의 환경성검토(환경영향평가)와 현행 환경영향평가법의 전략환경평가와 환경영향평가 및 소규모 환경영향평가 제도의 특징과 내용을 분석하여 볼 때, 도시·관리계획의 입안·결정과정에서 주민의 의견수렴절차가 보다 강화되어야 할 필요성이 제기된다. 또한 현행 환경영향평가제도는 일정한 경우 공청회의 개최를 의무화하는 조문을 두고 있는데, 실무적 측면에서 비추어 보면 그 범위가 매우 제한적이며, 또한 환경영향평가서 초안의 공고·공람 등이 대단히 형식적으로 되어 있다는 점에서 한계가 있다. 더욱이 환경영향평가서 협의 단계에서 주민참여가 불합리하게 제한되고 있다는 점에서 많은 문제점을 제기된다. 따라서 환경영향평가제도의 본래의 취지와 기능적 측면을 고려하여, 정보제공 및 의사결정지원기능의 현실적 보장을 위하여 주민의 의견수렴절차를 더욱 확대하거나 내실을 기하여 그 실효성을 담보하는 방안을 강구하여야 한다. 그리고 현행법상의 전략환경영향평가 대상계획, 환경영향평가와 소규모 환경영향평가의 대상사업에 있어 법규 사항으로 주민의견수렴절차와 함께 환경성 영향을 검토하는데 있어 전문기관, 자문기관 등에 의뢰하여 보다 정밀하고 전문적인 접근을 행할 것을 요구하고 있으나, 관계 행정(중앙)기관의 협의절차까지 일련의 과정이 체계적으로 복잡하고 많은 시간을 요한다는 점에서 그 실효성에 의문이 있는바 재고(再考)할 필요성이 있다. 따라서 이러한 여러 가지 문제점으로 인하여 실무상 환경영향평가 초안서 작성과 환경영향평가서 작성 등 그 과정에서 실무수행과의 조화가 원활하지 않을 것으로 생각된다. 이러한 사항을 고려하여 법제상의 합리적인 방안에 관한 논의와 검토를 거쳐 결론적으로 현실적인 대안을 모색하는데 기여하고자 한다.

It is necessary to strengthen the process of collecting suggestions from local residents when drawing up and setting the plan for the management system of cities and counties. This suggestion was made by analyzing the features and contents of the following three factors: The environmental impact assessment of the National Land Planning Act, the strategic environmental impact assessment of the current Environmental Impact Assessment Act, and the small scale environmental impact assessment system.

Also, the current environmental impact assessment system has the provision that requires holding certain public hearings, which is very limited when examining the practical aspects. Moreover, the announcements and the display within the first draft of the environmental impact assessment sheet are excessively formal. Further, the participation of the local residents is unreasonably limited during the consultation process of the environmental impact assessment sheet, which can present many problems.
