    출생의 근원을 알 권리는 개인이 자신의 생물학적·가족적 기원에 관한 정보를 통해정체성과 삶의 연속성을 구성할 수 있도록 하는 사생활상의 핵심 이익이다. 유럽인권재판소는 유럽인권협약 제8조의 ‘사생활(private life)’ 개념을 확장하여 출생기원 정보 접근이익을 그 보호영역에 포함시키면서도, 이를 곧바로 “식별정보의 공개”를 결과로 요구하는 절대적 권리로 선언하지는 않았다. 유럽인권재판소의 핵심 관심사는 익명출산과 제3 자 생식세포 기증이라는 제도적 맥락에서 출생자의 정체성 이익, 친생모·기증자의 사생활 및 건강·안전, 제3자의 권리, 공익 사이의 긴장을 어떠한 “조정절차”로 완화하고 있는지에 있다.
    본 논문은 Odièvre v. France에서 확립된 판단틀이 Godelli v. Italy에서 “절대·불가역적 익명성”의 위법성을 통해 강화되고, Cherrier v.     This article analyzes the right to know one’s originsas an identity-related interest protected under Article 8 of the European Convention on Human Rights. Focusing on anonymous birth and third-party gamete donation, it shows that the European Court of Human Rights (ECtHR) has not treated origin-information access as an absolute right to disclosure. Instead, the Court evaluates whether domestic law strikes a fair balance between the applicant’s identity interest and competing interests such as the biological mother’s privacy and safety, donor anonymity, third-party rights, and public interests in health and the stability of relevant systems.
    Through close case analysis, the article traces the Court’s core structural criterion: not “disclosure versus non-disclosure” as an outcome, but whether the legal framework avoids reducing the applicant’s access to zeroby providing workable procedural arrangements. In Odièvre v. France, the Court recognized origin-information access as a potentially “vital interest” within private life, while upholding France’s intermediary model. In Godelli v. Italy, the Court found a violation where the system offered no meaningful access even to non-identifying information and no mechanism to revisit the mother’s choice. In Cherrier v. France, the Court reaffirmed that an intermediary procedure that operates in practice may satisfy Article 8 even if anonymity is maintained. For donor conception, Gauvin-Fournis and Silliau v. France illustrates the Court’s reliance on the absence of a clear European consensus and on legislative deliberation and transitional design in assessing proportionality.
