학부 교양 교과로서의 법교육 = Legal Education in Undergraduate GE Courses

다국어 초록 (Multilingual Abstract)

Legal education in undergraduate GE courses should foster the ability to present the best explanation of legal phenomena in a society and the ability to find justifiable grounds for its legitimate legal system. Such education should incorporate a process that encourages students to justify their arguments based on their own logical reasoning. In this paper, usefulness and importance of liberal education are reviewed in first. Secondly, some peculiar reasons why liberal education has not been established in our society are examined. Thirdly, it is proposed why some education of law should be an essential part of liberal education. Finally, I suggest some directions for liberal and democratic education of law and offer some details of the curriculum and practical guides for legal GE classes.

국문 초록 (Abstract)

학부 교양 교육으로서의 법교육은 법현상에 대한 최선의 설명을 제시할 수 있거나 법제도의 발견과 적용 및 그 준수의 문제에 대한 정당화 근거를 비판적으로 재구성할 수 있는 능력을 길러주는 형태로 수행되어야 하며, 그러한 교육은 피교육자의 논리적 사유능력으로부터 결론을 정당화해 나가는 것을 조장하는 과정이어야 한다. 본고는 ‘인문학 교육’, 또는 ‘교양교육’이라고 불리어 온 자유학문적 교육의 유용성과 의미를 되짚어보고, 우리 사회에서 자유학문적 교육이 만족스럽게 정착되지 못한 몇 가지 이유를 살핀다. 나아가 일정한 범주의 법에 대한 교육이 자유학문적 교육의 필수적 일부가 되어야 하는 이유와 자유학문적 교육으로서의 법교육은 어떤 모습이어야 하는지에 대해 논의하고, 자유학문적 교육으로서의 법교과 운영의 실례를 제안한다.
