한국 수사경찰의 발전과제 = Tasks for Development of Police Investigation System in Korea

국문 초록 (Abstract)

한국의 수사경찰은 실질적인 수사를 대부분 담당하면서도 그에 걸맞는 위상이나 권한은 주어지지 않는 비정상적인 상황을 안고 있다. 이는 경찰의 수사력 향상에 장애요인으로 나타나고 다시 시민의 불신과 협조의 결여를 가져오는 악순환의 고리를 만들고 있다.
한국수사경찰의 문제점은 첫째, 수사권배분의 적정화가 이루어지지 않아 책임과 권한이 불분명하고 효율적 수사에도 장애요인으로 작용하고 일선 수사관의 사기저하를 유발하고 있다. 둘째, 열악한 수사경찰의 지위는 조직내부로 이어져 인사교육의 상황에도 파급되고 있다. 셋째, 경찰 수사력의 약화는 시민의 불신을 가져와 협조를 구하기 어렵게 되었다.
이러한 한국수사경찰의 열악한 지위를 개선하기 위해서는 전술한 문제점을 효과적으로 개선하여야 하는 바 우선적으로 수사권을 검찰과 경찰이 적정하게 배분하여 수사의 효율성을 기하고 권한과 책임을 동시에 갖게 하여야 한다. 이러한 수사경찰의 지위향상은 뛰어난 인재의 수사부서 지원을 통하여 양질의 수사요원을 확보할 수 있게 되고, 이는 다시 경찰의 수사력 제고로 이어져 시민의 신뢰를 향상시킬 수 있는 선순환 구조로 전환될 것이다.

다국어 초록 (Multilingual Abstract)

Police investigation system in Korea face the abnormal circumstances of not being given the appropriate status and authority even though they are mostly in charge of substantial criminal investigations. Such circumstances are revealed as obstruction factors in improvement of the investigation ability, and creating a ring of a vicious circle bringing over citizens' distrust and a lack cooperation again.
The problems of police investigation system in Korea are as follows. Firstly, not only the responsibilities and authorities are vague and efficient criminal investigations are obstructed as appropriateness of allocating the investigation authority is not arranged, but also the morale of the investigators in the front line is being declined. Secondly, inadequate positions of police investigator lead to the internal organization, influencing the circumstances of personnel education. Thirdly, weakening of the investigation ability of police detectives brings over citizens' distrust, making difficult to seek cooperation.
In order to improve such inadequate positions of police investigators in Korea, abovementioned problems should be improved effectively. Thus, efficiency of criminal investigation should be ensured and the authorities and responsibilities should be given at the same time by allocating the investigation authority among the prosecution and police appropriately first. Such improvement in positions of police detectives allows securing of good investigating personnel through support of the investigation departments with outstanding talent, and such will lead to enhancement of the investigation ability of the police again, which will be converted to a virtuous cycling structure that could improve citizens' confidence.
