BBNJ 협정 수정초안의 CBTT 관련 규정의주요 내용과 쟁점 = Analysis of the Key Issues of CBTT-related Provisions in the Revised draft text of BBNJ Agreement

The BBNJ negotiations, which started in accordance with UN General Assembly Resolution 59/24 in 2004, went through nine Working Group meetings from 2006 to 2015 and four Preparatory Committee meetings from 2016 to 2017. After that, three Intergovernmental Conferences were held from 2018 to 2019, and the 4th Intergovernmental Conference, which had been postponed due to COVID-19, was held at the United Nations Headquarters in New York in March 2022.
In accordance with General Assembly Resolution 72/249, the Conference will address the topics identified in the package agreed in 2011, namely the conservation and sustainable use of marine biological diversity of areas beyond national jurisdiction, in particular, together and as a whole, marine genetic resources(MGRs), including questions on the sharing of benefits, measures such as area-based management tools(ABMTs), including marine protected areas, environmental impact assessments(EIAS) and capacity-building and the transfer of marine technology(CBTT).
In this paper, I will review the main contents and issues that have been discussed in the four Intergovernmental Conferences so far, and suggest a proposal for a desirable provisions in the following negotiations. However, since the scope of the issues covered at the Intergovernmental Conferences is very broad, this article will focus on capacity building and maritime technology transfer issues. The technology transfer and capacity-building are important foundations for conservation and sustainable use of marine biodiversity in ABNJ. ICBTT, one of the key issues being addressed in the BBNJ negotiation process, is actually a essential elements and enabler of key issues related to the other three issues: MGAs, ABMTs, EIAs. In short, the other three main issues of the BBNJ Agreement will not be realized without adequate capacity building and technology transfer. Therefore, in this paper, I analyzed the contents, related issues, and each country’s position on the main provisions of the ‘2019 Revised Draft Text’, which is very important for effectively achieving the objectives of the BBNJ Agreement. Therefore, I will suggest the CBTT-related provisions necessary to effectively achieve the objectives of the BBNJ Agreement.
The ‘2019 Revised Draft Text’ is stipulated in six articles (Articles 42 to 47) with the title of ‘Capacity-Building and Transfer of Marine Technology’ in Chapter 5 (Part V) on CBTT. Key issues related to the CBTT are whether the objectives of the CBTT is to be set out separately in Agreement, whether the cooperation, modalities, monitoring and review of the CBTT is mandatory or voluntary, whether a list of types of CBTT will be included in the treaty text or annexes, and whether to authorize periodic additions to the Conference of the Parties(COP).

국문 초록 (Abstract)

2004년 유엔총회 결의 59/24에 따라 시작된 BBNJ 협상은 2006년부터 2015년까지 9차례의 작업반 회의와 2016년부터 2017년까지 4차례의 준비위원회 회의를 거쳐서, 2018년부터 2019년까지 3차례의 정부간회의가 진행되었다. 코로나19로 인해 연기됐던 제4차 정부간회의는 2022년 3월 뉴욕 유엔본부에서 개최되었다. 2017년의 유엔총회 결의 72/249에 따라, 정부간회의는 2011년에 합의된 패키지에서 확인된 주제, 즉 국가관할권을 넘어선 해양생물다양성의 보존 및 지속가능한 이용, 특히. 이익공유 문제를 포함한 해양유전자원(MGRs), 해양보호지역을 포함한 지역기반관리도구(ABMTs), 환경영향평가(EIAs), 역량강화 및 해양기술 이전(CBTT)에 관한 문제를 ‘함께 그리고 전체적으로’ 다루고 있다.
정부간회의에서 다루고 있는 협정의 범위가 매우 광범위하기 때문에, 이 논문에서는 지금까지 4차례의 정부간회의에서 다루어진 네 가지 주요한 주제 중 역량강화 및 해양기술 이전과 관련한 규정으로 한정하여, 그 주요 내용과 쟁점, 그리고 각국의 입장을 분석하고자 한다. 협상 과정에서 논의되고 있는 핵심 주제 중의 하나인 CBTT는 실제로 MGAs, ABMTs, EIAs 등의 세 가지 주제와 밀접하게 관련되어 있는 사안으로 BBNJ 협정의 필수적인 요소이자 성공 요인이며 조력자이다. 요컨대 적절한 역량강화 및 기술이전 없이는 BBNJ 협정의 다른 세 가지 주요 의제가 실현되기 어려울 것이다. 그래서 본 논문에서는 BBNJ 협정의 목적을 효과적으로 달성하는데 매우 중요한 역량강화 및 해양기술 이전에 관한 내용을 ‘2019 수정초안’을 중심으로 그 주요 내용과 관련 쟁점, 그리고 각국의 입장을 분석하고자 한다. 결론으로는 BBNJ 협정의 목적을 효과적으로 달성하기 위해 필요한 CBTT 관련 조항의 바람직한 방향에 대해서 제안하고자 한다.
‘2019 수정초안’은 제5장(Part V)에서 ‘해양기술의 역량강화 및 이전’이라는 제목으로 6개 조항(제42조~제47조)에 걸쳐서 CBTT에 관하여 규정하고 있다. CBTT와 관련된 핵심 쟁점은 CBTT의 목적을 별도로 규정해야 하는지 여부, CBTT의 협력, 방식, 모니터링 및 검토가 의무적 또는/그리고 자발적으로 이행되어야 하는지 여부, CBTT의 유형의 목록을 조약 본문 또는/그리고 부속서에 포함할 것이지 여부 그리고 당사국총회에 정기적으로 유형을 추가할 수 있는 권한을 부여할 것인지 여부 등이다.
