헌법상 노인의 사회보장권 강화를 위한 노인학대 관련 법률의 합리화 방안 = A Study on Justification of the Laws related to Elder abuse to strengthen their Constitutional right to Social security

국문 초록 (Abstract)

본 연구는 우선 헌법상 노인에게 인정되는 기본권으로서 사회보장권에 관한 내용을 검토해 보았다. 그리고 이를 보다 강화하기 위해 우리나라 법률 가운데 노인학대 관련 내용을 다루고 있는 법률을 중심으로 그것의 내용과 법적처리절차를 분석해 봄으로써 노인학대 관련 법률의 합리화 방안을 모색하고자 하였다.
이를 통해 헌법상 노인의 사회보장권이 강화되기 위해서는 다음과 같은 노인학대 관련 법률의 합리화 방안을 도출할 수 있었다.
첫째, 노인학대 피해자의 사회보장권이 강화되기 위해서는 무엇보다 노인복지법의 정비가 우선되어야 한다.
둘째, 노인학대에 노출되기 쉬운 노인을 보호하기 위해 노인장기요양보험법의 학대 관련 내용을 보완할 필요가 있다.
셋째, 가정ㆍ성폭력관련 전문기관과 노인복지ㆍ의료관련기관 간의 연계 및 협력을 노인학대 관련 법률에 명문화할 필요가 있다.
넷째, 노인학대범죄 피해자의 2차 피해를 최소화하려는 형사절차상의 노인보호 방안을 강구해야 한다.

다국어 초록 (Multilingual Abstract)

This study reviews social security rights of the elder people as their basic constitutional rights. It also aims to strengthen and find out ways to justify laws related to elder abuse by analyzing laws about elder abuse in Korea and their legal procedures.
Through this analysis, several measures to justify laws related to elder abuse to strengthen their social security rights have been identified as follows.
First, law revision for The Elderly Welfare Act is required in order to secure basic rights of the victims against elder abuse.
Second, improvement of the provisions about abuse in Act on Long-Term Care Insurance for Senior Citizens should be made in order to protect elders from the elder abuse specially for those who may be easily exposed to it.
Third, collaboration between institutions for sexual harrassment or family problems and aged welfare or medical care should be stipulated in elder abuse relevant law.
Fourth, legal proceeding to protect victims from the second victimization should be strengthened.
