이 연구는 푸코의 생명정치 이론을 틀로 삼아 중대재해처벌법이 ‘생명과 안전’이라는 명분 속에서 실제로 어떻게 국가권력을 강화하고, 건설 현장 종사자들의 생명을 방치하게 되는지를 분석하는 데 목적이 있다. ‘생명을 보호하는 법’이라는 긍정적 상징과 달리 법 시행 후 산업재해 사망자 수가 유의미하게 감소하지 않고 있는 이 법의 역설적 현실에 주목하였다.
중대재해처벌법 제4조 제1항 제1호의 안전보건관리체계 구축 의무는 ‘살게 만드는 권력’의 안전 메커니즘적 특징을 보인다. 또, 해당 규정의 모호성은 국가권력의 확장을 가능하게 하는 근거로서 기능하기도 한다. 구체적으로 국가권력은 안전보건관리체계 구축의 핵심을 위험성평가로 규범화하고 있으며, 안내서와 컨설팅을 통하여 건설 현장의 일상적 실천까지 개입하고 있었다. 실천의 핵심이 된 위험성평가는 안전 예산의 실질적 뒷받침 없이는 작동하기 어렵다. 그러나 건설업의 생산 구조, 저가투찰 관행, 그리고 역대 최악의 건설 경기 불황 속에서 동법 시행령 제4조 제4호의 ‘안전 예산’ 규정은 사실상 형해화(形骸化)되고 있다. 이러한 맥락 속에서 ‘안전 예산’의 뒷받침 없이 작동하는 위험성평가는 처벌 회피의 전략으로써 사용되며 ‘죽게 내버려두는 권력’으로 전도되고 있다. 따라서 중대재해처벌법은 표면적으로는 생명권력의 ‘살게 만드는 권력’의 형태를 하고 있으나, 실제로는 국가권력이 규범화한 위험성평가 중심의 안전보건관리체계 구축과 형해화된 ‘안전 예산’ 규정이 맞물리며 ‘죽게 내버려두는 권력’으로 작동하고 있음을 밝혔다.
이 연구는 푸코의 생명정치 이론을 적용하여, 중대재해처벌법이 ‘생명을 보호하는 법’이라는 명분 아래 실제로는 건설업 종사자의 생명을 방치하는 방식으로 작동하는 생명권력의 역설적 메커니즘을 드러냈다. 이를 통해 법이 다양한 권력 메커니즘들이 경유하는 복합적 장으로 기능하고 있음을 밝힘으로써, 법과 현실의 간극을 밝히고 해결하려는 비판적 법사회학 연구로서 의의를 가진다.

This study uses Foucault’s theory of biopolitics as an analytical framework to analyze how the Serious Accidents Punishment Act (SAPA), under the pretext of “life and safety”, actually strengthens state power while neglecting the lives of construction site workers. It focuses on the paradoxical reality of SAPA, which, despite its positive symbolism as a “law protecting life” has failed to bring about a meaningful reduction in industrial accident fatalities since its implementation.
The obligation to establish a safety and health management system under Article 4, Paragraph 1, Item 1 of SAPA exhibits the characteristics of a safety mechanism within biopolitical power aimed at making live. However, the provision’s ambiguity serves as a legal basis for the expansion of state power. Specifically, the state has normalized risk assessment as the core of the safety and health management system, embedding it into the daily practices of construction sites through official guidelines and consulting. Yet, this core mechanism—risk assessment—is difficult to implement without meaningful support from safety budgets. Given the structural features of the construction industry, including its low-bid contracting practices and current recession, the “safety budget” requirement in Article 4, Paragraph 4 of the Act’s Enforcement Decree has become a hollow provision. In this context, risk assessment, devoid of real budgetary backing, is used as a strategy to avoid punishment and is inverted into a mechanism of the power to let die.
Consequently, this study reveals that while SAPA superficially embodies biopolitical power aimed at making live, it in practice enables the power to let die through the normalization of risk assessment and the formalization of a hollow safety budget. By applying Foucault’s theory of biopolitics, this paper exposes the paradoxical operation of biopower in SAPA: it functions not as a mechanism to protect life, but as one that neglects it. as a contribution to the Sociology of Law, this study highlights the law as a complex site through which multiple forms of power are exercised, offering a critical legal sociological perspective on the gap between legal norms and lived reality.
