In patent infringement litigation, the key evidence necessary to prove the existence of infringement and to calculate damages is predominantly concentrated within the control of the infringing defendant. As a result, the plaintiff, who bears the burden of proof, faces inherent structural difficulties in establishing the amount of damages with specificity. To address this evidentiary asymmetry, the document production order system under Article 132 of the Patent Act was introduced. However, in practice, even when defendants refuse to comply with such orders without justifiable grounds or respond in an uncooperative or insincere manner, effective sanctions remain insufficient. Consequently, the system has not been fully utilized.
The analysis reveals that although Articles 132(4) and 132(5) of the Patent Act allow the court to deem the plaintiff’s assertions to be true when a defendant fails to comply with a document production order, courts have applied these provisions in an extremely restrictive manner. This study conducts a comparative analysis of the relevant legal doctrines and case law in major jurisdictions, including the United States (discovery), China (orders for the production of documentary evidence), Japan (document production orders), and the United Kingdom (disclosure). The analysis demonstrates that these jurisdictions secure the coercive force of their disclosure systems by imposing strong sanctions for non-compliance, such as striking out claims or defenses, issuing default judgments, actively applying adverse inference doctrines, and, in some cases, granting the plaintiff’s claimed amount in full.
Based on these findings, this study proposes the following improvements. First, because the current sanctions for non-compliance with document production orders do not effectively alleviate the plaintiff’s burden of proof, it is necessary to lower the standard of proof in order to meaningfully reduce that burden. Second, the requirements for granting a document production order should be clearly distinguished from the requirements for accepting the plaintiff’s factual assertions as true. Third, in cases of intentional non-production or bad-faith compliance, courts should refrain from resorting to the discretionary application of Article 128(7) of the Patent Act, which allows the court to determine a reasonable amount of damages. Fourth, where appropriate, reciprocal document production obligations should also be imposed on plaintiffs to ensure procedural fairness. Fifth, from a legislative perspective, stronger sanctions—such as judgments against the non-compliant party or the imposition of administrative fines—should be introduced to enhance the effectiveness of the document production order system.
