정사영상 기반의 토지경계 규제선 설정에 관한 연구 = A Study on Land Boundary of restrictions Based on Orthoimages.

국문 초록 (Abstract)

본 연구에서는 우리나라에서 'Cadastre 2014'기반의 새로운 경계를 도입하기 위한 개념과 설정원리를 분석하고 지역·지구 등 규제선에 따른 토지객체 경계의 설정을 실험하여 정사영상 기반으로 새로운 개념의 경계설정방안을 제시하는 것에 목적이 있다.
연구내용과 결과를 요약하면 다음과 같다.
1. 'Cadastre 2014'선언은 1994년의 시각에서 본 20년 후의 지적에 대한 비전을 제시한 것으로 6개항의 선언문 중 선언문 1에서 제시한 “공적권리와 규제사항(public rights and restriction)을 포함한 토지의 모든 법률적인 현황을 보여줄 것이다”라는 것을 구현할 수 있도록 새로운 개념의 토지경계를 도입하기 위한 기본이론을 검토하였다.
2. 국토이용정보체계의 개념과 현황을 중심으로 토지이용·관리·규제에 대한 사항을 검토하여 지역·지구 등에 의해 구획되는 규제선 작성절차 및 정사영상의 작성에 대해 조사하였다.
3. 지역·지구 등의 종류와 법률관련 사항을 조사하고 법률적인 사항에 의한 토지객체에 작용하는 규제사항을 분류하였으며, 『측량·수로조사 및 지적에 관한 법률』에서 정의한 필지경계의 개념을 기본으로 『토지이용규제기본법』에 따른 규제사항을 추가하는 경계설정방안을 제시하였다.
4. 정사영상, 수치지형도, 지적도 및 지역·지구 등을 변환·중첩하여 토지객체의 개념으로 규제선에 의해 구획되는 경계에 대한 법률적인 규제사항을 적용하고 지역·지구 등을 중첩하여 생성되는 경계와 규제사항에 대한 특성을 분석하였다.
5. 정사영상을 기반으로 규제선을 작성하여 경계설정방법 중 항공측량방법에 의한 도면작성 및 활용에 대해 실험하였으며, 향후 세계측지계에 의해 제작된 지형도면 및 현실경계 중심의 규제선 도입에 대한 연구가 추가적으로 필요하다.

다국어 초록 (Multilingual Abstract)

This study aims to analyze concepts and principles to introduce a new boundary under the 'Cadastre 2014' in Korea, experiment with land object boundaries based on restriction lines such as areas and districts and thereby propose a boundary setting method of new concept based on orthoimage.
The findings from the study are summarized as follows:
1. The 'Cadastre 2014' Announcement states a cadastral vision for 20 years later from the 1994 viewpoint. In this study, we reviewed basic theories for the introduction of land boundary of new concept so that description of the overall legal situations of a land including public rights and restriction set forth by the first statement, among its 6th statements can be realized.
2. Focusing on the concepts and situations of the Urban Planning Information System, we examined issues about land use, management, and restriction and thereby investigated how restriction lines based on areas and districts and orthoimage are made.
3. We also looked into types of areas and districts as well as legal issues on the basis of which restrictions on land object were identified, and proposed a boundary setting method including restrictions under the Basic Law on Land Use Restrictions on the basis of the lot boundary concept defined by the Law on Survey, Waterway Investigation and Cadastre.
4. Orthoimage, digital map, cadastral map, and areas and district were converted and overlaid so as to apply legal restrictions on boundaries set by a land object concept restriction line and to analyze boundaries formed by overlaying areas and districts and characteristics of restrictions.
5. With the restriction lines made on the basis of orthoimage, we experimented with map drawing and utilization in the Aerial Survey Method among other boundary setting methods. Further studies are considered necessary in regards to topographic map made by the World Geodetic Datum and realistic boundary based restriction line introduction.
