Individual local income tax was converted from a surtax attached to the national income tax into an independent local tax in 2014. Since 2020, an independent filing system for individual local income tax has been implemented. With the introduction of the independent filing system, rules concerning the place of tax payment and return forms have been enacted or amended, but several legislative deficiencies remain. By comparing and reviewing the wording and structure of the Framework Act on Local Taxes, the Framework Act on National Taxes, and Form No. 40-11 of the Enforcement Rule of the Local Tax Act, this study examines the consistency of penalty tax relief provisions related to preliminary returns and entries concerning the date on which tax liability arises for individual local income tax, and proposes measures for improvement.
Penalty tax relief provisions related to preliminary returns under Article 57(2)4(a) and (b) of the Framework Act on Local Taxes have three issues. Those are the limitation of the scope of relief to individual local income tax on capital gains subject to preliminary returns, ambiguity as to whether the filing act in the article refers to a late return or an amended return concerning a preliminary return or to a final return, and ambiguity regarding the relationship between general penalty tax relief provisions for amended returns filed within a certain period and the relief provisions for amended returns related to preliminary returns. Another issue is that the instructions for Form No. 40-11 of the Enforcement Rule of the Local Tax Act state that the dates on which tax liability arises for individual local income tax in preliminary returns for domestic stock transfers and transfers of land located in a land transaction permit zone are the last day of the half-year in which the transfer date falls and the last day of the month in which the permit date falls, respectively, which may cause disputes among taxing authorities over revenue attribution.
To address these problems, Article 57(2), subparagraph 4 of the Framework Act on Local Taxes should be amended. Specifically, the wording that limits the scope of relief to individual local income tax on capital gains subject to preliminary returns should be deleted, and items (a) and (b) should be revised to clarify that the filing acts in the article refer to a late return or an amended return concerning a preliminary return under local tax laws. In item (b), as in the Framework Act on National Taxes, the phrase “notwithstanding items (d) through (f) of subparagraph 1” should be added to clarify its relationship with the general penalty tax relief provisions for amended returns filed within a certain period.
In addition, Form No. 40-11 of the Enforcement Rule of the Local Tax Act should be amended to be consistent with upper-level statutes and the corresponding rules for national taxes. This study contributes to improving the consistency of the legal framework governing preliminary returns for individual local income tax by proposing specific amendments.
