북한은 사회주의권 몰락에 따른 경제위기 극복을 위한 노력의 일환으로 라선경제무역지대(이하 “라선지대”라 함)와 황금평·위화도 경제지대와 같은 경제특구 개발을 추진해왔지만, 지난 20여년 간 이어진 이러한 노력들은 아직 결실을 맺지 못하고 있다. 최근 들어 남북관계의 악화, 북중 관계의 심화, 그리고 러시아의 연해주와 라선시에 대한 관심증대 등 여러 상황으로 인하여 북한의 경제특구 계획은 변화를 겪고 있다. 2011. 12. 3. 전면 개정된 ‘라선경제무역지대법’(이하 “개정 라선법”이라 함)과 ‘황금평, 위화도경제지대법’(이하 “황금평법”) 등을 채택함으로써 북한은 일정한 변화를 보이고 있다.
개정 라선법과 황금평법의 핵심은 크게 두 가지로 볼 수 있는데, 첫째는 전례 없는 중국과의 공동개발구도이고, 둘째는 개성공업지구의 기본 틀과 유사한 지도기관, 관리위원회, 개발기업으로 이루어진 3단계 관리 체계를 도입하였다는 점이다. 이러한 특징들로 말미암아 북한은 개성공단으로부터 얻은 교훈들을 십분 활용함과 동시에 기존의 북한당국 주도모델을 극복하여 성공적인 경제특구 개발을 지향하고 있다. 예컨대 개정 라선법과 황금평법이 수용에 있어서 적법절차의 원칙 및 차별금지의 원칙에 따라서 적시에 충분하고 효과있는 보상을 할 것을 규정한 점은 의미 있는 입법적 진전으로 볼 수 있고, “로력채용, 로임기준과 지불형식” 등에 있어서 기업의 시장원칙에 따른 자주적 결정을 인정한 것은 북한경제특구 법제에 있어서 진일보한 것으로 볼 수 있다.
종합적으로 볼 때 분명한 것은 이러한 노력들을 통하여 북한이 기업친화적 규정을 도입하고 분쟁해결 방안을 체계적으로 규정하는 등 입법적 발전을 보이고 있다는 것이다. 이러한 변화들은 북한이 스스로 회생할 능력이 부족하다는 점을 자인하고 새로운 방향의 경제회생을 추구하고 있음을 시사하며 중국과의 공동개발을 개혁개방의 체제위험 요소를 최소화 시키는 유일한 대안으로 삼은 사정을 엿보게 한다.
한편, 이번 계획이 전적으로 중국 측 투자에 의존한다는 점, 그리고 중국이 자본과 기술, 특구운영 노하우를 가지고 있다는 점에서 중국이 주도할 것으로 예상된다. 이는 중국이 향후 두 경제지대의 추진과 관련하여 중대한 정책적 레버리지를 갖게 됨으로써 북한에 그 영향력이 확대되고, 한반도 통일에 직접적인 영향을 끼칠 수도 있다는 것을 뜻하며 앞으로 귀추가 주목된다.

In an effort to cope with the economic hardships brought upon by the fall of socialism, the Democratic People's Republic of Korea (DPRK) has sought the development of special economic zones such as the Rason Special Economic Zone (RSEZ) and the Hwanggumpyong·Wihwado Special Economic Zone (HWSEZ). However, these efforts have yet to deliver solid results for the devastated economy. Amidst recent events such as the worsening of South-North Korean relationship, the intensification of North Korean-Chinese relationship, and Russia's increasing interest in Yeonhaeju and Rason, the DPRK's special economic zone projects face a new era of change. The DPRK is showing signs of such changes through instances such as the adoption of the revised 'Rason Economic Trade Zone Act' (RRETZA) on December 3, 2011 and the adoption of the 'Hwanggumpyong, Wihwado Economic Zone Act'. (HWEZA)
RRETZA and HWEZA contain two central elements: an unprecedented system of joint development with China and an administrative system based on three institutions very similar to that of the Kaesong Industrial Zone (KIZ). Based on these characteristics, it can be observed that the DPRK seeks to achieve success by overcoming the limitations of its original DPRK-led model for special economic zones and fully utilizing its lessons from the KIZ. For instance, the RRETZA and HWEZA's stipulation to provide effective and sufficient compensation through fair and unbiased legal procedures in case the state needs to expropriate the investors' wealth can be viewed as a meaningful step from a legislative aspect. Furthermore, the acknowledgement of independent, market-based decisions by the occupying firms regarding "employment, wage criteria, and form of payment" may be considered as another noteworthy advancement in the DPRK's special economic zone legislations.
Overall, it is certain from these observations that the DPRK is demonstrating clear legislative advancements such as attempting to implement business-friendly regulations and establishing a systematic arbitration procedure. These changes imply that the DPRK has realized it cannot recover on its own and views joint development with China as the only means of minimizing the potential dangers that often accompany reforms.
Meanwhile, it seems likely that China will take the lead in this project considering its resources, technology, and administrative experience with special zones. Furthermore, the project is entirely dependent on Chinese investments. This means that China will obtain considerable political leverage over the DPRK, which will expand its influence over the state and potentially over the peninsula's reunification process as well. Thus, it is necessary to pay close attention to future developments.
