Modern disasters are developing into complex risks that can no longer be explained solely in terms of the responsibility of a single administrative authority, due to factors such as the climate crisis, the increasing density of urban spaces, the interdependence of social infrastructure, and the wide-area spread of infectious diseases. Accordingly, disaster and safety affairs need to be understood as a matter of public-law responsibility involving the State, local governments, relevant administrative agencies, public institutions, and private actors.
This study examines the criteria for allocating responsibility between the State and local governments in disaster and safety governance, focusing on the Framework Act on the Management of Disasters and Safety. Starting from the constitutional duty of the State to protect public safety and the constitutional guarantee of local autonomy, this study analyzes the legal nature of disaster and safety affairs and proposes four criteria for responsibility allocation: primary responsibility, supplementary intervention, proportionality, and fiscal solidarity. Primary responsibility identifies the authority that must first make judgments and initiate action at each stage of disaster management. Supplementary intervention explains the conditions under which intervention by the State or metropolitan local governments may be justified. Proportionality controls the manner and scope of intervention by higher-level governments, while fiscal solidarity serves as a criterion for securing the costs and capacities necessary to perform assigned responsibilities.
This study also compares the disaster responsibility allocation systems of the United States and Japan and derives implications concerning field responsibility, supplementary support by higher-level governments, linkage between national standards and local plans, recovery support, and fiscal solidarity. Based on these findings, this study proposes several measures to improve Korea’s disaster and safety legal system: specifying the State’s general supervisory and coordinating authority, giving practical effect to local disaster and safety planning powers, institutionalizing metropolitan cooperation and mutual support among local governments, clarifying cost-sharing criteria, establishing legal responsibilities for supporting the recovery of daily life, and improving the criteria for post-disaster responsibility assessment.
Ultimately, the task of disaster and safety legislation is not to choose between expanding central authority and emphasizing local responsibility. Rather, it lies in establishing a public-law responsibility system that realizes both the constitutional value of public safety and that of local autonomy by clarifying, at each stage of disaster management, the starting point of responsibility, the conditions for intervention by higher-level governments, the limits of such intervention, and the criteria for cost-sharing and recovery support.
