This paper proposes the concept of “public-right land”—privately owned land encumbered by public rights—and explores management strategies in alignment with the recent introduction of the “Seoul-style Transfer of Development Rights(TDR)” system. Spaces such as building setbacks, privately owned public open spaces(POPOS), and public pedestrian passages are privately owned yet function as hybrid zones for public transit and recreation, significantly contributing to urban safety and the living environment. However, due to current institutional gaps, these spaces are not explicitly registered in cadastral records or real estate registries, leading to chronic management failures such as privatization, closure, and illegal occupation. The 2022 Itaewon tragedy serves as a stark illustration of the public safety risks arising from such management voids in public-use areas within private parcels.
Against this backdrop, this study is structured to review institutional gaps, define the necessity and concept of public-right land, and propose directions for improving the public disclosure system. Specifically, the study suggests a reform of the disclosure system that involves registering the spatial location and regulatory obligations of public-right land in cadastral maps and land ledgers, while recording TDR transaction details in the real estate registry. By doing so, this research seeks to establish a foundation for enhancing urban safety and public interest through the transparent management of public-use information on private land and the rational institutionalization of development right transfers and compensation.
