    Whether an ‘Act’ can be the object of a constitutional complaint based on Art.68 Sec.1 of the Korean Constitutional Court Act (hereinafter a “Sec.1 Complaint”) has almost never been a matter of question, either in the practice of Korean Constitutional Court (hereinafter “KCC”) or in the academic world. The only explanation, explicitly given by KCC, was that legislation is unquestionably included in the ‘exertion of public power’ provided in Art.68 Sec.1. But this apparent ‘dogma’ doesn’t seem to be compatible with a systematic interpretation of the present KCC Act, the elucidation of which is the purpose of this article.
    First, the KCC Act contains no provision at all concerning the effect of an Act struck down as a result of the Sec.1 Complaint, which is indispensible should Acts be eligible objects for a Sec.1 Complaint.
    Second, on a closer look together with Art. 75, the ‘exertion of public power’ provided in Art.68 Sec.1 can only include exertion thereof which is ‘concrete and particular’.
    Third, even something legislative can be properly included in the exertion above, it is an ‘act of enactment of revision of the Act itself’, not an ‘Act’ itself, which is nothing more than a product of the above act.
    Fourth, when KCC strikes down Acts in a Sec.1 Complaint, the manner in which KCC constructs the main sentence of its decision is disaccordant with the provision of KCC Act, the reason of which seems to be that KCC cannot abide by the KCC Act and enable Sec.1 Complaint on Acts at the same time.
    As a matter of interpretation of Sec.68 Art.1, it is at least ‘problematic’ to see Acts as eligible objects of Sec.1 Complaint. The problem must be dealt with, either by a novel theoretical work, or by a revision of the KCC Act.

    헌법재판의 실무나 학설에 있어서 법률이 헌재법 제68조 제1항의 헌법소원심판의 대상으로 되는가 하는 문제는 논의의 대상으로 되지 않는다. 헌재법 제68조 제1항의 ‘공권력의 행사’에 당연히 법률이 포함된다는 헌재의 결정이 이 문제를 둘러싼 이론적 검토의 전부다.
    그러나, 헌재법이 구체적 행정작용에 관한 규율만을 정하고 있음을 본다면, 법률이 당연히 헌재법 제68조 제1항의 헌법소원의 대상으로 된다는 입론은 성급한 것이라 평가할 수밖에 없다.
    이 논문에서 법률이 헌재법 제68조 제1항의 헌법소원의 대상으로 볼 수 없다고 보는 논거는, 첫째, 효력에 관한 규정이 전혀 없다. 둘째, 헌재법 제75조와 종합해 보면, 헌재법 제68조 제1항의 ‘공권력의 행사’는 구체적이고 개별적 작용만이 포섭되는 것이다. 셋째, 법률의 제정 또는 개정 작용이 공권력의 행사로 될 가능성은 있어도, 법률의 제정이나 개정작용의 결과물인 법률은 공권력의 행사가 될 수 없다. 넷째, 헌재는 법문에 어긋나는 방법으로 주문을 구성하고 있는데, 이것은 헌재법을 따르면서는 ‘법률’을 헌재법 제68조 제1항 소원의 대상으로 입론할 수 없기 때문이다.
