일원화 자치경찰의 과제와 나아갈 방향에 관한 연구 = A Study on the Tasks and Future Direction of the Unified Autonomous Police

The purpose of this study is to seek a stable system settlement ahead of the full implementation of the metropolitan autonomous police system on July 1, 2021. Founded in 1948 with the establishment of the government, the Korean National Police Agency has consistently raised the need to introduce a self-governing police system as a way to secure political neutrality. The problem is that the government's push for full implementation of the autonomous police system has ended about 75 years of debate and laid the foundation for a complete local government.
Since the implementation of the local government system in 1991, the local police system has been canceled due to various reasons, but it is not a fully dualized model of autonomous police. Each local government, which has been prepared for the enactment of the ordinance and the formation of a local police committee, will conduct a trial by June 30 and will be fully implemented in 17 metropolitan cities and provinces nationwide from July 1.
The purpose of introducing a self-governing police system shall be to secure the connection between local administration and security administration and provide security services suitable for regional characteristics, and the self-governing police shall be implemented to meet the specificity and autonomy of the area.
Prior to the full implementation of the self-governing police, various problems that arise through pilot implementation must be found and solved well to establish a stable self-governing police system. Above all, it is important to establish a stable system of citizen-centered police administration.
As the autonomous police committee is an independent and neutral administrative agency, it should be an urgent issue to drive both the city and provincial governors and the city and provincial police agencies to establish a stable settlement of the system so that citizens-centered autonomous police administration can take place.

국문 초록 (Abstract)

본 연구는 2021년 7월 1일 광역단위 자치경찰제 전면 시행을 앞두고, 안정적인 제도정착을 모색하기 위함을 목적으로 한다. 1948년 정부수립과 더불어 창설한 대 한민국 국립경찰은 정치적 중립성을 확보하기 위한 방안으로 자치경찰제 도입의 필요성을 꾸준히 제기되어 왔다. 문제인 정부에서 자치경찰제의 전면시행을 추진 하게 됨으로써 약 75년간 이어져온 논쟁을 끝내고 완전한 지방자치제의 기틀을 마 련하게 되었다는 것에 큰 의미가 있다.
1991년 지방자치제도 시행 이후 여러 정권에서 자치경찰제 추진이 여러 가지 이유로 무산되고 말았으나, 비록 완전한 이원화 모델의 자치경찰은 아니지만 수많 은 우여곡절 끝에 2021년 7월 1일부터 전국 광역단위 자치경찰제 전면시행으로 대 한민국에 역사적인 자치경찰 시대를 열게 되었다. 조례제정 및 자치경찰위원회 구 성 등 준비가 완료된 자치단체별로 6월 30일까지 시범실시를 거쳐 7월 1일부터는 전국 17개 광역시·도에서 동시에 전면시행을 하게 된다.
자치경찰제 도입취지는 지방행정과 치안행정의 연계성을 확보하고 지역특성 에 적합한 치안서비스를 제공하기 위하여 도입되어야 하며, 자치경찰은 국가의 순 기능을 보장하면서 지방분권이라는 자치성에 입각하여 그 지역의 특수성과 자율 성을 충족시키는 차원에서 실시되어야 한다.
자치경찰 전면시행을 앞두고 시범실시를 통해 발생하는 다양한 문제점을 발 견하고 해결과제를 잘 풀어나가야 안정적인 자치경찰제를 정착시켜 나갈 수 있다. 무엇보다 시민중심 경찰행정의 안정적 제도를 안착시키는 것이 중요하다.
자치경찰위원회는 독립적·중립적 합의제 행정기관인 만큼 시·도지사와 시·도경찰청의 양 기관을 잘 견인해서 시민이 중심이 되는 자치경찰행정이 이루 어지도록 제도의 안정적 정착화를 이루는 것이 시급한 현안으로 삼아야 한다.
아울러 경찰청에서는 지역치안을 담당하는 지구대·파출소를 자치경찰제도 본연의 취지에 맞도록 생활안전과로 소속을 변경하여 지역주민을 위한 민생치안 활동에 전념할 수 있도록 개선 해 나가야 하며, 지역특성에 맞는 자치경찰제를 성 공시키기 위해서는 정부의 적극적인 재정적 지원과 지속적인 관심이 뒷받침 되어 야 할 것이다.
