법률행위의 해석 = Interpretation of the juridical acts

다국어 초록 (Multilingual Abstract)

The purpose of this articel is to analyze the meaning of the article “Interpretation of the juridical acts” written by Prof. Tuck Soo Song in 1987. (hereinafter referred to as “the Article”). To this end, this article summarizes the main and special contents of the Article, and examines the theories and precedents on the subject at the time the Article was published. Based on this, after looking at the meaning at the time the Article was published and the present meaning, future research tasks are presented.
The Article found out that the interpretation of the juridical acts belongs to one of the core issues of the theory of the juridical acts. In consideration of the legal situation in which the Korean Civil Code does not have any provisions on this, the Article intended to present specific interpretation standards for this, after theorizing the method of interpreting the juridical acts. After the Article decided how to classify the interpretation of the juridical acts and which regulations of the Civil Code should apply to the interpretation of the juridical acts, referring to German theory and precedent, it discusses the significance, objectives, objects, eligibility of interpretation, and litigation issues of the interpretation of the juridical acts, and describes in detail the methods of natural interpretation, normative interpretation, and supplementary interpretation. On that basis, the theory of interpretation of the juridical acts is systematized from the perspective of how the theory of interpretation of the juridical acts in Korean civil law should be established. The Article is of great significance above all in that it established the theory of interpretation of the juridical acts in Korean civil law through this difficult work. Based on the establishment of a basic theory on the method of interpreting the juridical acts according to the general rule after the Article, the theory of interpretation of the juridical acts has been systematized after the 2000s, while discussions have been diversifying.
The future task is to formulate the legal principles on how to interpret contracts in conformity with the international contract norms in the face of increasing disputes related to contract interpretation in the area of international transactions. To this end, not only the study of international contract norms, but also theories and precedents on the general rules of contract interpretation in continental law states, especially France, should be studied. In addition, research should be conducted to legislate regulations on the general rule of interpretation of the juridical acts in Korean Civil Code.
