As financial transactions increasingly move online, growing attention has been paid to dark patterns that shape consumer decision-making. Existing surveys and the Korea Fair Trade Commission's guidelines, however, focus primarily on general e-commerce and do not fully account for the distinctive features of financial product transactions, including intangibility and statutory disclosure obligations. This study analyzes dark patterns arising in the non- face-to-face sale of financial products and examines where the current supervisory guideline on dark patterns in online financial product sales may require supplementation.
A total of 91 cases were collected from the mobile applications and websites of 33 Korean financial institutions over a five-month period in 2024. Drawing on these cases, sixteen types of dark patterns specific to online financial product transactions were derived and analyzed by product category, stage of consumer decision-making, and the degree of regulatory intervention required.
By category, misleading patterns accounted for 37.2 percent of cases, followed by obstructive patterns at 29.8 percent, pressuring patterns at 28.7 percent, and exploitative patterns at 4.3 percent. Hidden information and false hierarchy together comprised more than a third of all cases. Patterns commonly observed in general e-commerce, such as false discounts and low- stock notifications, were not identified. Differences across product categories were observed: removal of disclosure process steps appeared only in investment products, while trick questions appeared only in lending products. Across decision-making stages, cases concentrated at the purchase decision stage, yet a substantial number were also found at earlier stages, indicating that the basis for consumer judgment may be constrained well before a contract is concluded.
Fifteen of the sixteen types identified in this study correspond to the classification set out in the supervisory guideline issued subsequently, while differences in legibility between the pre-contractual and contractual stages were not included in that classification. On this basis, the study proposes internal review procedures covering the transaction process as a whole rather than individual screens, and suggests that binding regulation be considered for the types causing the greatest consumer detriment once the effects of self-regulation can be assessed.
