일본의 ADR 제도에 관한 고찰 = A Study on the Japanese ADR System

다국어 초록 (Multilingual Abstract)

The title of this thesis is ``A Study on the Japanese ADR System``. It would be meaningful to logically verify how to reorganize the ADR System and what aspects to consider for the reorganization in the Legislation Process of ADR system in the future. Of course, it would be difficult at the present moment to predict exactly what problems may arise in the future. However, there should be efforts to find solutions for problems related to regulation of public order so that the risk of causing unreasonable consequences can be minimized. In principle, disputes occurring between private parties are to be resolved by court adjudication. Due to the cost and time involved, however, alternative dispute resolution (ADR) has been introduced to either supplement or substitute court adjudication. Since ADR System is something that is being newly developed, a thorough examination of past problems can lead to a future ADR System that is more rational and accords with substantial justice. Therefore, to rationally reorganize the ADR system, it is necessary to evaluate how this system has changed through the years. I explained about the main contents of ADR system in Japan and dealt with the important contents of ADR system and suggested especially the problems and improvements in connection with the Japanese ADR System.
