공공갈등관리를 위한 제도정비방향 = Institutional Reform for Conflict Management in the Public Sector

다국어 초록 (Multilingual Abstract)

Globalization, participatory democracy and emergence of new public management theory create new governance in the public sector. It reflects societal changes triggered by borderless economy, increased diversity in the society and emergence of knowledge-based information society.
Under such circumstances, the traditional parliamentary system does not suffice reflecting complicated relations of interest in diversified society not to mention the public opinion. Public disputes have not been properly handled through traditional dispute resolution methods. For theses reasons, we need to establish new conflict management systems in the public sector. New systems require the new public decision-making paradigm based upon people's participation, consensus building and collaboration. In the new paradigm, social corporatism and deliberative democracy are outstanding ways of thinking. Although the two are not necessarily connected, they commonly stress the importance of social consensus in policy-making and dispute resolution process.
In the light of social changes and paradigm shifts in policy-making and dispute resolution process all over the world, I conclude that a wide variety of institutional reforms as follows should be implemented in order to prevent public disputes and achieve consensus dispute resolution in the public sector.
First, social reforms for people's basic needs
Second, the paradigm shift in public decision-making process from command and control to participation and collaboration
Third, formulation of social capital through education and publicity
Fourth, activation of Alternative Dispute Resolution in the public sector
Fifth, establishment of legal systems for the clients in the public sector.
