다국어 초록 (Multilingual Abstract)

The subsidiarity is widely supported as the principle of multi-level governance not only for the supra-national organization and federal state but also for the nation states. However in the nation state subsidiarity principle, which is a distribution rule among politically equal power units, may be in conflict with decentralization practices which the state devolves its power to local units. As subsidiarity principle is basic tenet in democratic regime, this paper pursues methods for the application of subsidiarity principle under state-sovereignty dominant regime. For this purpose the paper advocates the need for conceptual development local sovereignty for local autonomy, amendment of legal provisions in local autonomy law which conflict with subsidiarity, and introducing new procedures which incorporate the principle of subsidiarity.

국문 초록 (Abstract)

보충성은 권한배분 원칙으로서 초국가조직이나 연방제 구성원리로 뿐만 아니라 지방분권의 이론적·실천적 근거로서 많은 나라에서 높은 지지를 받고 있다. 그러나 국가주권의 이념 아래서 형성된 지방자치제에서 보충성은 아직 국가와 지방간의 권한배분 관계를 규정하는 원리로서 그 이론적 기반이 미약하다. 보충성은 권한을 공유하는 독립된 단위간의 권한배분의 원칙으로서 단지 하위단위에 우선적으로 권한을 배분한다는 이양의 개념을 넘어서기 때문이다. 이 논문은 거버넌스 시대에 보충성 원칙의 위치를 확실히 하기 위해 지방자치권에 대한 새로운 이론을 발전시켜야 할 필요성을 제기하면서 지방주권 이론의 발전, 보충성과 상충되는 법규정의 개정, 보충성 원칙에 입각한 제도의 도입을 주장한다
