국내외 딥페이크 성범죄 처벌 제도 분석을 통한 국내 제도 발전 방향 = Analysis of Domestic and International Legal Systems for Punishing Deepfake Sex Crimes and Proposals for Advancing South Korea's Legal Framework

국문 초록 (Abstract)

인공지능의 발전은 의료, 교육, 금융 등 다양한 분야에서 혁신을 가져와 우리의 삶을 더욱 편리하게 만들었으며, 삶의 질을 크게 향상시켰다. 이러한 기술 발전은 사회적 및 경제적 성장에도 기여하고 있다. 그러나 AI 기술이 항상 긍정적인 결과만을 가져오는 것은 아니다. 기술이 발전하면서 새로운 범죄 유형과 부작용이 발생하고 있으며, 그중 딥페이크 기술이 큰 주목을 받고 있다. 딥페이크 기술은 인공지능을 이용해 인간의 이미지와 음성을 합성하는 기술로, 원래는 창의적 목적으로 개발되었으나, 최근 들어 성범죄, 허위 정보 유포, 금융 사기 등 다양한 범죄에 악용되고 있다. 특히 딥페이크 성범죄는 피해자의 동의 없이 성적 콘텐츠를 생성·유포해 피해자의 명예와 사생활을 심각하게 침해한다. 이러한 범죄는 피해자의 인격과 권리를 위협하며, 피해자에게 큰 심리적·사회적 고통을 초래한다. 이에 따라 여러 국가에서 딥페이크 성범죄에 대한 처벌 강화 요구가 커지고 있으며, 한국에서도 관련 범죄 수사가 증가함에 따라 법적 대응이 중요해지고 있다. 본 연구에서는 국내외 딥페이크 성범죄에 대한 처벌 제도와 대응을 분석하고, 입법적 노력의 필요성을 제언한다.

Artificial intelligence has brought innovation to various fields such as healthcare, education, and finance, significantly enhancing the convenience of our daily lives and improving our overall quality of life. These technological developments have also contributed to social and economic growth. However, AI technology does not always yield solely positive outcomes. As technology progresses, new types of crimes and unintended side effects have emerged, among which deepfake technology has garnered significant attention. Deepfake technology, which utilizes AI to synthesize human images and voices, was initially developed for creative purposes. Nevertheless, it has recently been exploited for various criminal activities, including sexual offenses, the dissemination of false information, and financial fraud. In particular, deepfake-based sex crimes involve the creation and distribution of sexual content without the victim's consent, severely violating the victim's privacy and dignity. Such offenses pose threats to the personality and rights of the victims, causing significant psychological and social harm. Consequently, there is a growing demand in various countries for more substantial penalties against deepfake-related sex crimes. As investigations into such offenses increase, the need for a robust legal response has become more urgent in South Korea. This study aims to analyze domestic and international legal systems and reactions to deepfake-based sex crimes, emphasizing the necessity for legislative efforts to address these emerging issues.
