교육입법정책에 관한 기초 연구 = Study on Educational Legislation Policy

다국어 초록 (Multilingual Abstract)

This study analyzes the legislation policy in the areas of educational legislation, to free itself from limitations in traditional studies which focused on interpretation or application of current educational laws. First of all, the concept of educational legislation policy must be fixed not in the narrow sense but in the broad sense of including law making process from the policy cycle of setting agendas properly to educational legislation evaluation. Also, a legislator must obey the educational legislation policy not only to the general principal of legislation policy but also the special principal of educational law along with the balance ``right to receive education equally`` and ``right to receive education according individual to student`s abilities``. Finally, this study suggests four things to carry out educational legislation policy desirably. Firstly, educational legislation policy should aim at the guarantee of right to receive education essentially. Secondly, educational legislation policy should be changed which centers on the students and parents, not for government. Thirdly, in educational legislation policy should be observed, the spirit of the constitution that fundamental matters pertaining to the educational system shall be strictly obeyed by act. Lastly, the educational legislation evaluation system should be introduced.
