트레이드 드레스에 대한 디자이너들의 이해도 조사 연구 = 제품디자이너와 UI/GUI디자이너 간의 이해도 차이를 중심으로

국문 초록 (Abstract)

2011년 4월 미국의 애플사는 미국 캘리포니아 법원과 네덜란드 법원 등에 삼성전자의 ``갤럭시``모델이 자사의 모델을 표절하였다고 소송을 제기하였다. 애플이 주로 문제 삼은 것은 디자인과 UI/GUI 디자인의 트레이드 드레스 침해이다. 우리나라는 세계 4위의 특허출원 규모에 비해 특허관리 시스템은 취약한 것으로 분석되고 있다. 이러한 영향으로 정부 및 학계에서는 디자인보호 강화에 많은 관심을 가지고 있으며 다양한 지원이 시도되고 있다. 본 연구는 디자인 경쟁력 강화 요소로 중요해지는 트레이드 드레스에 대한 제품디자인 및 UI/GUI 디자인 전문회사의 디자이너들의 이해도를 설문방법을 통하여 알아보는데 그 목적이 있다. 연구 결과 전문회사에서 근무하는 디자이너들의 트레이드 드레스에 관한 이해도는 전반적으로 부족한 것으로 조사되었다. 구체적으로는 UI/GUI 디자이너들이 제품디자이너들에 비해 대한 디자인 보호제도 전반에 관한 이해가 부족한 것으로 조사되었다.

다국어 초록 (Multilingual Abstract)

In April, 2011, Apple filed a law suit against Samsung in U.S. District Court in Northern California and Dutch Supreme Court, alleging the Galaxy infringed on a number of the company`s patents and trademarks. Apple insisted that Samsung`s latest products look a lot like their product, from the shape of the hardware, screen icon design, to the user interface and even the packaging, total of 16 cases. In addition to the case above, the suit differs from previous cases in terms of alleging infringement of "trade dress"on design and UI/GUI design. According to analysis, Korea, as the world`s fourth -largest patent-scale, revenue generation and defense capabilities, and patent management system, are vulnerable. In this effect, government and academia have been putting a lot of attention and variety of support in strengthening patent and design protection. This study aims to research understanding level on trade dress-which becomes important competitiveness factors for product design-of designers in UI/GUI specialized firms through survey. And the result from this research is expected to be utilized as basic data to provide plan for applying effective design protection law for small and medium-sized businesses, and training design right for designers. As a research of this research, most of designers don`t understand about trade dress. Compared to product designers concretely, UI/GUI product designers don`t get enough understand about trade dress.
