다국어 초록 (Multilingual Abstract) kakao i 다국어 번역

The National Assembly recently revised Telecommunications Business Act (“the Act”) to strengthen the regulations on mobile app markets. The revision of the Act was triggered by Google's new policy on in-app purchases, announced on September, 2020. According to the new policy, app developers would have to pay as a commission 30% of the sales amount of every in-app purchase for various online digital media contents, similar to what Apple did. Because Apple and Google require app developers to use only their billing systems for in-app purchases, the app developers, who are business users of the app market, are not allowed to use alternative billing systems and thus have no choice but to pay the 30% commission. It is far from strange that many app developers showed strong objections against Google’s new policy as well as the current app market commission regime itself.
The revised Act prohibits app market operators such as Apple and Google from forcing a specific billing method on app developers, and preventing multi-homing by disadvantagesouly treating app developers who are trying to register their apps on other app markets. However, such a prohibition, an ex post behavioral regulation, could not prevent Google from finding a detour to avoid it.
With a close analysis on the current app market structure and its status quo, the dominant market powers of the duo-pole Google and Apple and the anti-competitiveness of their billing policies for in-app purchases are evident and thus can justify the regulations on the app market. Therefore, in order to effectively regulate the market and prohibit abusive behaviors, ex ante regulation would be more preferable.
However, the need for regulating the app market does not justify the need for regulating the entire online platforms. The online platforms are diverse in their types and business models, and it is not an easy task to find the existence of entry barriers and/or market dominance. Above all, in a country like Korea where domestic platform operators are growing to become competitive, it is necessary to strike a balance between promotion and regulation of such platform operators. This article’s arguments for the regulation should be limited to a specific market like the app market, in which it seems possible to foster competition by regulating the global big-tech’s abusive behaviors.
