범죄예방과 국가ㆍ공공단체의 역할 = The Role of Central Agency and Local Government in Crime Prevention

국문 초록 (Abstract)

검경수사권 조정문제가 최근 일단락됨에 따라 그와 함께 논의되었던 자치경찰제도 머지않아 시행될 것으로 보인다. 자치경찰제가 시행된다면 범죄예방분야도 새로운 국면을 맞게 될 것이다. 그동안 범죄예방업무는 국가경찰에 명시된 업무로서 지방자치단체는 아주 제한된 범위에서만 그 보조적 역할을 해왔다. 그러나 자치경찰제가 시행된다면 지방자치단체는 범죄예방업무에서 주도적 지위를 가지게 될 것이다. 범죄예방활동이 단순히 순찰활동을 의미하는 것에서 벗어나 다차원적이고 복합적인 전략을 필요로 하는 변화된 환경에서 그러한 전략을 실행하는 데 필요한 부서를 대부분 갖추고 있는 지방자치단체는 현대 범죄예방조직에 가장 적합한 기관이라 할 수 있다. 이론적 관점에서 보면, 범죄예방 전략은 세 가지 영역에서 실행될 수 있다. 범죄경향성 억제영역, 범행기회 억제영역, 누범 억제영역이 그것이다. 범죄경향성 억제영역에서는 일반 억제(엄격한 입법, 신속하고 확실한 범죄자 체포 및 처벌), 범죄적 소인을 가진 개인에 대한 치료 및 심리상담(가정개입), 개인의 성공적 사회화과정을 위한 개입(가정개입과 교육개입), 지역사회의 조직화 등의 전략이 필요하며, 범행기회 억제영역에서는 CPTED, 상황적 범죄예방전략 등이 필요하며, 누범억제 영역에서는 특별억제, 무능화, 처우 및 갱생, 관리전략 등이 필요하다. 따라서 지방자치단체는 이렇게 다차원적이고 복합적인 범죄예방전략을 효율적이고 효과적으로 실행하기 위해서 첫째, 자치경찰과 별도의 범죄예방 전담부서를 설립하여야 하며, 둘째, 범죄예방 전문 코디네이터를 두어야 하며, 셋째 범죄예방과 복지의 융합을 통하여 주민 삶의 질을 실질적으로 높일 수 있게 할 것 등이 요구된다.

다국어 초록 (Multilingual Abstract)

Recently, with the solution of the issues of distribution of investigative authority between prosecutors and police, the local police system, which was discussed with them, is expected to come into effect soon. If the local police system is implemented, crime prevention will also face a new phase. Until now, criminal prevention work has been specified in the National Police Agency, and local governments have played an auxiliary role only to a very limited extent. However, if the local police system is implemented, local governments will have a leading position in crime prevention work. Local governments, which have most of the departments needed to implement the strategies in a changed environment that criminal prevention activities require a multidimensional and complex strategy, are the most suitable institutions for modern crime prevention organizations. From a theoretical point of view, a crime prevention strategy can be implemented in three realm. They include realm for deterrence of criminal tendency, realm for deterrence of crime behavior’s opportunities, and realm for deterrence of recidivism. In the realm for deterrence of criminal tendency, strategies such as general deterrence (strict legislation, swift and sure arrest and punishment of criminals), treatment and psychological counseling (home intervention) for individuals with criminal traits, intervention for successful socialization of individuals (home intervention and education intervention), and the community s organization. In the realm for deterrence of crime behavior’s opportunities, strategies such as CPTED, situational crime prevention strategies, etc. are required, In the realm for deterrence of recidivism, strategies such as special deterrence, treatment, rehabilitations are required. Therefore, local governments should establish a separate crime prevention division with the local police in order to efficiently and effectively implement such a multi-dimensional and complex crime prevention strategy, second, have a coordinator specializing in crime prevention, third, make the quality of residents lives practically better through the convergence of crime prevention and welfare.
