[Purpose]This study reassesses Korea’s gasoline loss deduction scheme under a prepaid fuel tax regime and explores how the current statutory wording and institutional design should be refined.
[Methodology]The analysis identifies the current statutory provisions and revision history, examines Korea’s market and regulatory environment, and compares Japan, selected U.S. states, and EU arrangements across four axes: risk attribution, loss concept, recognition technique, and institutional adaptability.
[Findings]The 2020 reduction from 0.5 to 0.2 percent can be understood as an adjustment reflecting expanded vapor-recovery regulation and lower evaporative losses. Yet the statutory phrase, “natural reduction due to evaporation, etc.,” may not cover some non-fault pre-sale losses, while Korea combines a low fixed-rate deduction with a narrow loss concept and simplified recognition.
[Implications]Korea should retain the 0.2 percent fixed-rate deduction, while separately recognizing only those additional losses that are proven to have occurred before sale and without fault. Candidate cases include dead stock, residual oil after unloading, and mandatory sampling. To prevent open-ended claims, this relief should be confined by clear eligibility rules, evidentiary requirements, exclusions, caps, and ex post review.
