유통산업발전법상 대규모점포규제에 관한 소고 - 유통산업발전법 개정안에 대한 논의를 중심으로 - = A Review on Restriction on Large Scale Stores under the Distribution Development Act - Focused on Proposals for Revision of Distribution Industry Development Act -

국문 초록 (Abstract)

20대 국회에 제출되어 있는 다수의 유통산업발전법일부개정안들은 유통산업에 대한 규제를 강화하는 내용을 담고 있다. 대규모점포의 시장진입장벽을 높이기 위해 허가제를 도입하고 현재 대형마트와 기업형 수퍼마켓에 대하여 적용되고 있는 의무 휴업일, 영업시간 제한 등의 규제를 백화점, 복합쇼핑몰 등 대규모점포 전반으로 확대하는 것 등이 여러 개정안의 주요 내용이다. 경제활동인구 감소와 경제성장률 둔화 등으로 국내 경제의 저성장기조가 심화되고 있으며 소비침체도 장기화될 우려가 있다. 사회구조적인 측면에서 고령화 사회로 급속히 진입하고 나홀로 가구와 여성의 사회활동이 증가하고 있다. 정보통신기술(Information and Communication Technology, 이하“ICT”)의 발달과 스마트폰 사용자 증가로 모바일쇼핑, 소셜커머스를 통한 공동 구매가 확산되고 있다. 이러한 경제적 · 사회적 환경의 변화로 인해 대규모점포와 지역상권, 골목상권 간의 이해조정을 위한 경제규제적 특징을 가지는 유통규제만으로는 유통산업의 발전과 유통업 전반의 상생협력도 기대하기 어려울 것으로 보인다. 유통산업발전법 개정안은 민간의 자율성과 창의성, 시장기능의 활성화, 유통업 전반의 상생협력 등의 유통산업 정책방향에 부합하는 내용은 결여된 것으로 보인다. 대규모점포 등이 기존 상권과 상생협력할 수 있는 제도를 도입하고 이와 함께 도시계획, 사회 · 환경문제를 고려하여 대규모점포를 개설할 수 있도록 유통산업 규제의 패러다임을 전환해야 할 것이다.

다국어 초록 (Multilingual Abstract)

The 20th National Assembly has proposed several bills of the Distribution Development Act to strengthen the regulation of the distribution industry. The proposals include adoption of permission system for establishment of large scale stores instead of the current registration system, application of mandatory closing of stores and restriction of business hours to department stores, complex shopping mall which are currently applicable to large retail discount stores and super supermarkets, etc. The low growth trend in the Korean economy has been deepened in accordance with the decline of the economically active population declines and slow economic growth. There are also concerns that consumption downturns would be prolonged. The Korean social structure has rapidly entered an aging society. Also single person households and women's social activities have rapidly risen. In terms of technology, development of ICT and increase of smart phone users have made widespread group purchase using mobile phones and social commerces. Considering the above changes in the distribution industry, it would be desirable to convert regulatory paradigm to the social and environmental regulation. The current economic regulation of the distribution industry is based on the grounds that large scale stores should be restricted to protect the interests of traditional markets and small and medium size stores. However, win-win cooperation among the concerned market players rather than treating them as having only conflicting interests would be necessary for development of the distribution industry. The proposals for revision of the Act seem to take position of the same economic regulation as the current Act. It would be desirable to adopt systems which assist cooperation among large scale stores, traditional markets and small and medium size stores and to change regulatory paradigm from the economic regulation to the social and environmental regulation.
