This study was to consider about criminal liability as negligence of the teaching staff on serious accident case in skiing instruction of school and university.
Therefore, I could find out conclusion following;
First, in snow skiing instruction of school and university serious accident like severe injury or death as negligence of the teaching staff be assume criminal liability of professional negligence by criminal law article 268(be sentenced to 5 years or less imprisonment/ be paid 20,000,000 won of less penalty).
Second, the occurring teaching staff that criminal liability on serious accident case as negligence themselves in skiing instruction of school and university also be assume administrative liability of dismissal, release from office, suspension from office, pay cut, reprimand, and revocation of position etc.
Third, countermeasure and relief of the teaching staff about criminal liability that the teaching staff must do attentional obligation of teacher best and they appeal to legal basis such as principle of reliance between student and teacher in sport, permissional sport activity by criminal law article 13, and peculiarity of sport like opinion of approval of danger, self fault, and irresistable force.
Fourth, the teaching staff on occasion of snow skiing instruction of school and university be act according to reason and rationality on any case, and they could be escape criminal liability.
In Conclusion, the teaching staff on occasion of snow skiing instruction of school and university cannot act according to illegal professional negligence and fault of guidance and inspector, namely violation of attentional obligation assumed criminal liability.

학교스키수업에는 결과가 중상 심지어 사망이라고 하는 중대한 사고에서부터 염좌, 골절과 같이 자주 발생되는 상해에 이르기까지 여러 가지 커다란 사고가 발생하는데, 나에게는 결코 그런 불행한 사고가 일어나지 않으리라는 안일한 생각으로 교원들은 스키수업에 임하며 간단한 상해에 대해서는 그 원인을 검토하지도 않고 방치해 둔다. 그러나 이와같은 간단한 상해가 상황에 따라서는 중대사고의 원인이 되는 경우도 있다. 몇 년동안 거의 커다란 사고가 없이 안전대책은 완전하다고 자부했던 학교스키수업에서도 사고는 갑자기 발생하는 것이다. 그래서 그러한 갑작스런 중대사고에 대처하는 체제가 준비되어 있지 않으면, 사고를 당했을 때 심각한 문제가 발생되기 때문에 사전에 대책을 세워 두어야만 한다.
학교스키수업 사고에 대한 대책은 기본적으로 피해자의 구제라는 측면에서 생각해 볼 수 있으며 대부분의 피해자는 학생이지만 본 연구에서의 초점은 학교스키수업 사고 발생시 교원은 사고책임자로서 사고에 대한 법적 책임을 질 수 있는데 그 법적 책임에 대한 피해를 최소화하고 교원의 법적 책임에 대한 대처와 구제라는 측면에서 살펴보고자 하였다.
그리고 사고가 교원의 지도상과실에 의해서 발생한 경우에 있어서 사망이나 중상과 같은 중대사고는 중대한 과실을 범한 교원에 대해서 형사책임을 추구하는 경우가 종종 있다.
그러므로 본 연구에서는 학교스키수업 중대사고시 사고책임자인 교원들에게 교원의 과실여부로서 처벌을 받는 형사책임에 관한 지식과 정보 등을 제공하여 형사책임에 대한 적극적이고 능동적인 법적 대처와 구제로서 교원들이 효과적인 학교스키수업을 할 수 있도록 교원의 형사책임 문제를 고찰하였다.
