Since the primary purpose of impeachment proceedings is to uphold the rule of law, all stages—including the filing of the motion, the hearing, and the final decision—must strictly adhere to the Constitution and relevant laws in accordance with this principle; furthermore, the right of the accused official (the respondent) to a defense must be guaranteed throughout the entire process. However, the current National Assembly Act contains only five provisions regarding the impeachment process, leaving significant legislative gaps.
To date, the Constitutional Court has adjudicated a total of 15 impeachment cases, with procedural issues arising during the impeachment prosecution process recently emerging as key points of contention. As prior research has largely focused on the substantive requirements for impeachment, this study aims to examine the procedural aspects that have become central issues in recent impeachment proceedings. In particular, by identifying deficiencies and areas for improvement in the National Assembly Act’s provisions regarding impeachment procedures, this study argues for the necessity of enacting a separate “Act on Impeachment Prosecution Procedures” independent of the National Assembly Act.
The main contents of this study are as follows.
First, a study was conducted on measures to ensure that a proposed impeachment motion is automatically reported to and placed on the agenda of the plenary session. Under the current National Assembly Act, there are no explicit provisions regarding the deadline for convening a plenary session to address a proposed impeachment motion, nor are there procedures for handling situations where the Speaker fails to report the motion to the plenary session; consequently, there is a risk that the processing of the motion could be effectively blocked by the Speaker’s inaction or delay in convening the session. Therefore, this study explored ways to secure the effectiveness of the impeachment power by clearly defining the obligation to convene the plenary session, the deadline for doing so, and the requirement for automatic agenda placement once an impeachment motion is proposed.
Second, a study was conducted on making the investigation by the Legislation and Judiciary Committee—currently viewed as a discretionary procedure under the National Assembly Act—a mandatory step. This research examined the necessity of mandating such an investigation to address the gravity of impeachment, prevent political abuse by the majority, and ensure the substantive nature of the impeachment trial.
Third, the National Assembly Act stipulates that the service of the original and certified copies of the resolution on impeachment must take place “without delay.” Accordingly, a study was conducted on replacing the phrase “without delay” with a specific deadline to narrow the gap between the time the impeachment resolution is passed and the time it is served.
Fourth, given the expectation that the proposal of an impeachment motion would trigger severe national division and political strife, the need to withdraw or drop such a motion was examined as a means to mitigate these issues. Consequently, the study analyzed the feasibility of withdrawing the motion after it has been proposed and reported to the plenary session but before it is formally placed on the agenda, as well as the possibility of dropping the motion at any point prior to the Constitutional Court’s final ruling.
Fifth, a proposal to introduce a statute of limitations was examined to prevent the pursuit of impeachment for political purposes long after the grounds for impeachment had originally arisen.
