This research investigates the establishment of the colonial judicial framework during the Japanese colonial period and the resultant perversion of legal principles, while also aiming to reveal the factors contributing to the endurance of this judicial system throughout the US Army Military Governance until the Constitution's adoption. This method allows us to examine the historical conditions that necessitated dependence on colonial judicial system and the constraints of the prevailing powers, as well as the initiatives aimed at countering Japanese imperialism. Presently, nearly 80 years following the emancipation from Japanese domination and the formation of the country, it is indeed unclear what defines a remnant of Japanese imperialism. This research seeks to differentiate between time and temporality, positing that the endeavor to eliminate the vestiges of Japanese imperialism aligns with the pursuit of reinstating a rule of law state that colonialism has perverted. Moreover, highlighting that the lingering complexities with the colonial judicial framework remain apparent in contemporary judicial reform laws and associated dialogues, this research aims to underscore the necessity for ongoing reflective contemplation. Taking these factors into account, it was established that the colonial judiciary during the Japanese occupation served as a tool for reinforcing the imperial authority of the Governor-General of Korea, rooted in the tenets of the Emperor system; notwithstanding the superficial semblance of contemporary judicial reform, it diverged significantly from the modernity anticipated as a rule-of-law state that safeguards civil rights and curtails political authority. Given that the judicial system under the U.S. Army Military Governance functioned solely as an instrument for administering the occupied region, the legal framework from the Japanese colonial period was unavoidably retained as a customary practice. It was discovered that although Japanese influence played a role in the creation of the Constitution and its results, it can be viewed favorably since it provided the intellectual and institutional groundwork of the era and was thoughtfully reinterpreted. In the context of the post-colonial period, it is essential to embrace new traditions and recognize hybridity instead of outright rejecting all aspects of Japanese imperialism; this will be pivotal in transforming the rule by law into the rule of law. From this viewpoint, it is essential to contemplate that actions we do not presently acknowledge as tradition—like courts that do not inspire confidence in equitable trials and judges who adhere to the system inside a bureaucratic collective mindset—continue to endure. Moreover, in light of the recent judicial reforms prompted by this essential consciousness, we may ascertain the obligation to pursue equitable trials and the assurance of people' fundamental rights that extend beyond simple judicial oversight. This suggests that although contemporary discussions on judicial reform have not overtly prioritized the elimination of the Japanese colonial heritage, there remains much insight to be gained from our skewed modernization and autonomous endeavors. Furthermore, this presents specific ramifications for modern judicial reform.
