국문 초록 (Abstract)

인간은 사회를 구성하고 그 사회 안에서 다른 구성원들과 협력, 경쟁, 갈등하며 삶을 존속하고 사회를 유지시켜 나간다. 사람들 간에 혹은 집단 간에 갈등이 발생하였을 때 그 갈등을 해결 할 수 있는 일차적인 방법은 상호간의 의사소통이라 할 수 있다. 집단의 의사전달에 있어 인간은 그들의 의견을 좀 더 효율적으로 주장하기 위해 그 형태는 집회나 시위로 발전되어 왔다.
최근 우리나라의 집회ㆍ시위 양상은 적법한 절차를 거쳐 합법적인 집회ㆍ시위로 시작하였으나 그들의 의사를 전달하는 과정에서 의사전달이 원활하게 이루어지지 않거나 타 집단과 충돌하면서 폭력적이고 과격한 불법시위로 변질되는 경우가 많다. 이는 집회ㆍ시위에 참가한 시위자 혹은 제3자에게 피해를 가져오고 사회질서의 안녕을 위협하는 심각한 사회문제로 인식되었다.
날로 증가하는 집회ㆍ시위와 다르게 경찰 내에서 채증을 담당하는 정보경찰의 인력이나 교육, 장비 등의 현실은 급변하는 집회ㆍ시위의 양상을 따라 대처하기엔 매우 부족한 현실이다. 따라서 경찰은 정보경찰의 채증 효율화를 통해 불법적인 집회나 시위를 예방하고 차단하며, 일관된 법집행을 통해 헌법이 보장한 표현의 자유의 실질적인 목적을 보호할 수 있는 수단을 확보해야 할 것이다.

In the communication as a group, the form of it has developed to public rallies and protests with a view to insisting more effectively on their opinions.
In terms of the aspect of public rallies and protests in korea recently, Those begin as legal forms through proper procedures. But those frequently turn into a violent and radical illegal behaviors when it is a failure to communicate or when their opinions conflict with other groups. These facts have been recognized as severe social problems which cause many demonstrators to be damaged and which threaten the order or stability of a society.
Nevertheless, The number of intelligence police to cope effectively with public assemblies increasing gradually, the education on the aspect of rapidly changing public rallies and protests, and police equipments are absolutely lacking.
Therefore, Police authorities should prevent and cut off the illegal assemblies through the effectiveness of information gathering conducted by intelligence policemen and should have the ways of protecting the practical purpose of freedom of expression which is guaranteed by the Constitution through a consistent law enforcement.
