성인대상 성적 그루밍 방식의 성폭력 평가 = Assessment of sexual violence in adult sexual grooming methods

국문 초록 (Abstract)

최근 성적 그루밍(sexual grooming)이 성폭력의 새로운 방식으로 부각되고 있다. 그동안 아동 · 청소년 대상 성적 그루밍에 대한 연구들은 지속적으로 이루어져 왔고, 이는 각국에서 형사법상 성폭력의 새로운 처벌규정의 근거로도 명시되었다. 우리나라도 아동·청소년 대상 성적 그루밍에 대하여 처벌하는 규정을 일부 언급하고 있으나, 여성학자들은 더 강한 처벌과 개정을 요구하고 있다. 그러나 성인대상 성적 그루밍에 대한 연구들은 전 세계적으로 극히 일부에 불과하고 법률적으로 처벌규정을 둔 나라도 거의 없다. 그러함에도 국내에서 성인대상 성적 그루밍에 대한 논의들이 시작된 것은 유명인사에 의한 성폭력 사건의 재판에서 언급되면서 이슈화된 것이다. 이에 우리 법원에서는 이를 근거로 처벌하는 규정이 없는 상태에서 이와 가장 유사한 현행법상 위계에 의한 강제추행죄를 적용하여 형벌을 부과한 바 있다. 성인대상 성적 그루밍의 단계를 제시한 Grant Sinnamon(2017)의 7단계를 검토한 결과, 아동·청소년보다 상황판단이나 정보네트워크 등에서 더 월등한 힘을 가진 성인도 성적 그루밍이 될 수 있다는 언급을 하고 있다. 하지만 사실상 이는 사랑하는 연인들 간의 성관계에서도 충분히 발생할 수 있는 요소라는 점을 고려한다면, 단지 추상적 개념으로 이해되는 성에 대한 지식, 힘, 만족의 평등을 기준으로 성인대상 성적 그루밍과 연인 간 낭만적 성관계를 구분하는 게 가능한지 의문이 들 수밖에 없다. 결론적으로 성인대상 성적 그루밍 방식의 성폭력에 대한 접근들은 더 많은 연구들이 뒷받침 될 필요가 있으며, 특히 이러한 성인대상 성적 그루밍 방식이 현행법상 위계에 의한 성폭력과 어떠한 차이가 있는지 명확한 기준을 수립하는 노력들이 있어야 할 것으로 판단된다.

다국어 초록 (Multilingual Abstract)

Recently, sexual grooming has emerged as a new method of sexual violence. Studies on sexual grooming for children and adolescents have been continuously conducted, which has been used as the basis for new penalties for sexual violence in criminal law in each country. Korea also mentions some regulations punishing sexual grooming for children and adolescents. However, female scholars are calling for more substantial punishment and revision. However, studies of sexual grooming for adults are scarce worldwide, and few countries have legal penalties regarding adult sexual grooming. Nevertheless, sexual grooming for adults emerged as a hot topic in Korea since it was mentioned in the trial of sexual violence by celebrities. Accordingly, in the absence of a proper provision for punishment, the Korean court imposed punishment by applying the most similar current law, the crime of an indecent assault by compulsion based on hierarchies. To examine adult sexual grooming, we reviewed the 7th stages of Grant Sinnamon (2017), which suggested the stages of sexual grooming for adults. Although Sinnamon mentions that adults with superior power in situational judgment or information network than children and adolescents can also be sexual grooming, it is questionable whether it is possible to distinguish sexual grooming for adults and romantic sex between lovers because sexual knowledge, strength and satisfaction in relationships do not always appear equal even between lovers. In conclusion, more studies still need to examine the approaches to sexual violence in adult sexual grooming methods. In particular, more effort should be made to establish clear standards for how these sexual grooming methods for adults differ from sexual violence by hierarchy under the current law.
