2012년도 헌법판례 동향 = An Analysis on the Major Constitutional Court Cases in 2012

국문 초록 (Abstract)

2012년 한 해에도 수많은 헌법재판이 쏟아졌다. 깊은 사회적 파장을 불러일으켰던 결정들 또한 등장하였다. 특히 법원과 헌법재판소 사이의 갈등을 야기할 만한 결정들이 등장하여 법조계와 학계를 긴장시켰다. 실질적 측면에서 법원 판결에 대한 헌법재판소의 위헌 결정과, 제정법 해석을 둘러싸고 법원 판례에 대한 헌법재판소의 한정위헌 결정 등, 굵직한 현안을 학계와 실무에 던져주었다. 이들을 비롯하여 깊이 있는 판례가 많이 등장하여 발전된 헌법재판의 모습을 제시하였다고 평가할 수 있겠다.

다국어 초록 (Multilingual Abstract)

Like earlier years, we had many cases in the Consitutional Court in 2012. Some of them received attention not only from the academia, but also from the society. Particularly, the jurisdictional conflicts between the Supreme Court and the Constitutional Court became a major focus from jurists. The possibility of constitutional review on a regular court decision will be a critical matter for the stability of the entire judiciary. More academic researches are needed to evaluate the major cases for the development of the Constitutional Court of Korea.
