치료감호 가종료자의 재범요인과 재범률 감소방안에 관한 연구 = A Study of Recidivism Factors and Policy Reducing Recidivism among Mentally Disordered Offenders

국문 초록 (Abstract)

각박한 현대사회를 살아가고 있는 사람들 중에는 각종 정신질환을 겪고 있는 사람들이 늘어나면서 이들로 인한 범죄가 증가하고 있다. 정신질환자들이 과연 일반인들보다 범죄의 위험성이 높은지에 대해서 논란이 많았지만, 대체로 최근 연구에서는 일반인보다 위험성이 높다는 것이 일반적인 견해이다. 한국에서도 이러한 정신장애 범죄자를 처우하기 위한 다양한 형사정책을 추진하고 있지만, 정신장애 범죄자들의 재범률이 일반 범죄자보다 높은 것으로 나타나고 있다. 그러나 한국에서는 아직 정신장애범죄자의 재범요인에 관한 경험적인 연구가 많지 않아 그 원인을 명확하게 알기 어렵다. 정신장애 범죄자는 일반 범죄자와 달리 정신질환이라는 특이한 속성을 가지고 있어 이러한 부분을 제대로 파악하기 위해서는 실증적인 연구가 필요할 것이다. 이 연구는 치료감호소에서 가종료로 퇴원한 145명의 보호관찰대상자를 대상으로 이들이 재범을 하게 되는 사회환경적·정신질환적 요인을 분석해 보고, 정신장애 범죄자 처우의 정책적인 변화를 통해 재범률을 감소해 나가는 한편, 향후 정신장애 범죄자의 재범예측도구를 개발하기 위한 기초연구로서의 역할을 하고자 한다.

다국어 초록 (Multilingual Abstract)

The recent increase in the number of crimes committed by people with mental disorder has been making the public concerned and worried. After the long-standing debates whether people with mental disorder are more dangerous than those without mental disorder, it has been consistently recognized in recent research that mental disorder has a correlation with violent crime.
In 1987, Korea government enacted「Psychiatric Custody Act」whereby the Forensic Hospital were established. However, the recidivism rates after discharge from the Forensic Hospital was reported to be higher than any other general offenders.
However, there have been no development of predictive tools and empirical research on the causes of recidivism for mentally disordered offenders in Korea. Thus, the aim of this study is to examine the recidivism factors for criminals with mental disorder and suggest policy reform for reducing recidivism rate. For this study, a total of 145 probationers discharged from the Psychiatric Hospital was selected and compared the recidivism factors between recidivism group and non-recidivism group.
Even though it could be found useful results from this research, it still contains some limitations of the study. Its sample size was relatively not enough for empirical study, and neither affective factors nor treatment status of participants were considered. Thus, it is suggested that sufficient sample should be recruited and supplementary survey on factors associated with recidivism should be added in the future research.
