      최근 헌법개정안에 나타난 지방분권형 개헌의 방향과 과제

      Since the implementation of the current Constitution in 1987, the local autonomy of various amendments to the Constitution is aimed at strengthening the Constitution, which is beyond the scope of institutional guarantee and devolution. This tendency is the result of experience of local autonomy for more than 25 years. Although the
      essence of local autonomy is explained by the convergence of group autonomy and resident autonomy, there is also the meaning of improvement on the fact that the statutes are composed mainly of group autonomy and devolution.
      And it can be said that a strong decentralization in the academic world as well as the political world is demanding from the reflection on the harmful influence of the centralized ruling structure since the foundation of the nation. It is the desire of the majority of the people to try to raise the quality of life of the people by institutionalizing the decentralization at the federal level while maintaining the single nationality by using the failure of the so - called central ruling system as a teacher.
      Since the legislative research is not a science for predicting the future, it is impossible to predict whether or not the decentralization of the federal level will succeed. However, if we analyze the results of the pilot implementation of Jeju Special Self-Governing Province and the contents of the constitutional amendment proposals, a strong decentralization is likely to be much more successful.
      Expecting the possibility of success of the constitutional amendment, I tried to analyze the common points and analyze the theoretical points by extracting mainly the contents of local autonomy from the recently proposed constitutional amendment. It will be used as basic data for the study of the constitutional amendment direction of the
      local autonomy system and the study of the succeeding law such as the Local Autonomy Act after the constitutional amendment,
      The direction and task of the amendment obtained from the results of the analysis are as follows. First, the direction of the amendment of the regionalization is a decentralization close to that of the federal system. It allocates the legislative, judicial and administrative powers, which were exclusive to the state, in harmony with local
      governments. Secondly, a constitutional reinterpretation of sovereignty, which is at least a federal level of decentralization without denying the indivisibility of sovereignty, is necessary. Third, the constitutional status of the local council as a self-governing legislative body by the direct election of the residents should be redefined. Fourth, the autonomous right of the residents, who are regarded as the right under the Act, needs to be newly added to the list of basic rights of the Constitution as political basic rights
