중대재해처벌법 쟁점과 개선에 대한 연구 -건설산업의 기업범죄 관점에서- = A Study on the Issues and Improvements of the Serious Accidents Punishment Act : From the perspective of corporate crime in the construction industry

This research paper discusses the legal nature of industrial accidents from the perspective of construction industry crimes and aims to address emerging issues and potential improvements in light of the impending expansion of the Serious Accidents Punishment Act. The contention regarding ’excessive punishment‘ argues that the severity of punishment should be proportionate to the responsibility of the top management of the company and that the legislation by the state determines the severity in accordance with the principle of proportionality and the constitutional prohibition of excessive legislation. Recognizing that strengthening punishment alone cannot be expected to prevent crimes, the paper advocates for effective strengthening of fines based on legislative precedents in the United Kingdom. The contention regarding ’expanded scope of application‘ suggests expanding it to companies with five or more permanent workers to address ongoing serious accidents, while emphasizing the need for government support for small and medium-sized enterprises to establish the system and continuous education enhancement for a shift in safety consciousness among stakeholders. The purpose of enacting the Serious Accidents Punishment Act has revealed that even though it aims to secure the safety and health obligations of employers and management executives and promote accident prevention activities, profit-driven corporate management with non-compliance of obligations constitutes organized corporate crime.
