시민성을 기준으로 조명한 사회적 소수자의 권리 = 노숙인 사례를 중심으로

국문 초록 (Abstract)

사회적 소수자의 권리에 대한 대부분의 논의들은 ‘소수자 집단 내부’의 인권실태를 조사하거나, 이들에게 동등한 시민권을 보장하라는 요구에서 그치는 경향이 있었다. 그러나 소수자라는 사회적인 상태는 다수자의 존재를 고려하지 않고서는 온전히 설명할 수 없다. 역사적으로 소수자의 권리는 다수자의 권리를 침해하지 않는 한해서, 그리고 다수자들이 묵인하는 범위 내에서만 제한적으로 보장되어왔기 때문이다. 따라서 본 연구는 사회적 소수자와 다수자의 관계 속에서 권리가 어떻게 배타적으로 구축되고 있는지를 살펴보고자 하였다. 이를 위해 본 연구는 시민권이나 인권에 선행하는 전제조건으로서 ‘시민성(citizenship)’ 개념을 도입하였다. 시민성 개념은 시민권을 넘어서 ?시민으로의 등록 ? 시민다운 덕성 ?시민이 수행해야할 의무-권리 ? 시민의 기본적인 소유를 아우르는 다층적 원리이다. 특히 본 논문에서는, 논의를 구체화하기 위해, 위 네 가지 차원의 원리들이 사회적 소수자인 ‘노숙인’을 ‘주거인들의 권리’로부터 어떻게 배제시키는지를 역사적 실례를 들어 논의하였다.

다국어 초록 (Multilingual Abstract)

Numerous people have endeavored to find alternative approach to social minorities which is predicated on the human and citizen rights in theoretical and political ways. As for the research case of this paper, there are also varied studies or social movements for the rights of the homeless. However, most debates are only focusing on superficial ‘conditions’ of encroachment over social minority rights. They hardly analyse the fundamental causes of discrimination.<br/>
To overstep these limits, this study firstly identifies the ‘preconditions’ of human and citizen rights that are only inclusive of social majorities, while they are working exclusively against social minorities. This study introduces ‘citizenship’, which is often mistranslated as ‘citizenship rights,’ as the framework. Citizenship originally involves ① registration as the citizens, ② rights and duties of the citizens, ③ civil morality, and ④ material and immaterial possession of the citizens. These criteria are usually constructed on the basis of social majority characteristics.<br/>
This paper subsequently applies these citizenship criteria to the case of the homeless. It examines not only general mechanism but also concrete examples of how citizenship functions between the homeless and the housed. The first aim of this paper is to study the multilateral attributes of encroachment over the homeless rights, which has been neglected in the human rights discourses. This study is also to detect and deliberate similar mechanism excluding social minorities in general from human rights.
