지적직 공무원 시험 응시 자격 개선 연구 = A Study on the Improvement of Qualifications for Cadastral Officials Examination

The Cadastral law has clearly stipulated that only those who have acquired Cadastral Technology Qualifications under the National Technical Qualification Act can perform cadastral measurements. However, on November 15, 2022, the Ministry of Personnel Management revised the Public Officials Appointment Test Decree, adding not only cadastral engineers but also survey and topographic spatial information technicians to the qualifications of Cadastral Public Officials. Accordingly, the change and range of duties of cadastral engineers were considered and the qualification of cadastral engineers who stipulates by the National Technical Qualification Act were analyzed. Cadastral survey is divided into surveys conducted by cadastral survey performers and public officials of the cadastral agency. As a result of the study, even after the 「Cadastral Law」 was integrated into the 「Acts related to Surveying and Hydrographic Survey and Cadastral Lands」, it was stipulated that surveying under this Act could only be conducted by surveying engineers, and it was clear that only cadastral engineers could conduct cadastral surveying. It was confirmed that the scope of duties for each regulation and technical qualification was specified in the old 「Cadastral Law」. Also, regarding qualifications and technical experience, it was confirmed that the areas of cadastral and surveying were clearly divided, managed and operated in the Enforcement Decree of the Spatial Information Management Act and the Construction Technology Promotion Act. Therefore, in order to improve the qualifications for taking the examination for cadastral officials, the revision (proposal) of cadastral-related laws and an amendment (proposal) of the Public Officials Appointment Test Decree were derived.

국문 초록 (Abstract)

지적측량을 수행할 수 있는 자를 지적법령은 명확하게 「국가기술자격법」에 따른 지적기술 자격을 취득한 사람만이 할 수 있다고 규정하여 왔다. 그러나 2022.11.15. 인사혁신처는 공무원임용시험령을 개정하여 지적직 공무원의 응시 자격에 지적기술자뿐만 아니라 측량 및 지형 공간정보 기술자를 추가하는 오류를 범하였다. 이에 지적기술자의 변천과 지적기술자의 직무 범위를 고찰하였고 「국가기술자격법」에서 정하고 있는 지적기술자의 자격에 대하여 분석하였다. 지적측량은 지적측량수행자가 수행하는 측량과 지적소관청 공무원이 실시하는 측량으로 구분된다. 연구 결과 「지적법」이 「측량·수로 조사 및 지적에 관련 법률」로 통합 된 후에도 이 법에서 정하는 측량은 측량기술자가 아니면 할 수 없다고 정하고 있으며 또한 지적기술자만이 지적측량을 수행할 수 있다는 명확한 규정과 기술 자격별로 직무 범위가 舊 「지적법」에 명시되어 있음을 확인할 수 있었다. 또 자격 및 기술경력과 관련해서는 「공간정보관리법」과 「건설기술 진흥법 시행령」에도 지적과 측량 분야가 명확하게 구분되어 관리·운영되고 있음을 확인하였다. 따라서 지적공무원 시험 응시 자격 개선을 위하여 지적 관련 법령의 개정(안)과 「공무원임용시험령」 개정(안)을 도출하였다.
