ILO 회원국 감독 제도 대응을 위한 해사노동협약 해석론적 연구

국문 초록 (Abstract)

ILO는 1919년 설립부터 채택된 노동협약의 당사국 이행증진을 모니터링하기 위해서 정기적으로 연차보고서를 제출하도록 규정하였다. 그리고 총회에서는 제출된 보고서를 검토하는 절차를 마련했다. 이러한 제도를 정기적 감독 제도라 한다. 그러나 동 제도는 계획과는 달리 시간 소모적이고 전문적인 작업이었기 때문에 총회에서 실시하는데 한계가 있었다. 이러한 문제를 해결하기 위해 서 현재의 전문가위원회와 기준준수위원회를 설립하였으며, 이 제도는 특별절 차와 함께 ILO의 목적을 달성시키는 데 있어서 효과적인 제도적 장치로 평가 받고 있다.
이 논문은 해사노동협약 당사국의 정기적인 감독 제도의 연혁적 고찰을 통해서 국제법적으로 동 제도가 갖는 의의를 재조명하였다. 또한 해사노동협약의 국제법적 의의와 협약논의 과정부터 제기되었던 협약의 구성, 형식 그리고 탄력적인 규정과 관련된 국제법적인 쟁점을 고찰하였다. 이를 통해서 정기적 감 독 제도에 대응하기 위한 우리나라의 이행 방향을 제시하였다.

다국어 초록 (Multilingual Abstract)

ILO has stipulated that annual reports shall be submitted on a regular basis to monitor the implementation of States parties to the International Labour Convention from its establishment in 1919. In addition, the assembly established a procedure for reviewing submitted reports. This system is called the regular supervision system. However, unlike the plan, time-consuming and professional review work could not be carried out at the Assembly, so the committee of expert on the application of conventions and recommendations and the committee of the application of conventions and recommendations were established to perform the task entrusted from the assembly. It has been evaluated as an effective institutional tool with special procedures.
This study examined the significance of the system under International law through a historical review of the regular supervisory system of States parties to the Maritime Labour Convention(MLC). In addition, the legal significance of the MLC and international legal issues related to the composition, form, and flexible provisions of the Convention issued from discussing the convention were considered. Through this, the Republic of Korea's implementation direction to cope with the regular supervisory system was suggested.
