    This article aims to explore institutional directions for strengthening the guarantee of children’s right to be heard and enhancing welfare-oriented interventions for children in conflict with law, by comparatively analyzing Scotland’s Children’s Hearings System alongside Korea’s child protection and juvenile justice procedures. In Korea, child protection procedures and juvenile justice procedures have long operated in ways that fail to sufficiently hear and reflect the views of children as parties to the proceedings. Moreover, because these procedures are fragmented under the Child Welfare Act and the Juvenile Act, welfare-based interventions for children involved in crime or delinquency have remained limited.
    Against this backdrop, this article takes the Scottish Children’s Hearings System—under which children’s right to be heard is guaranteed throughout the entire procedure and children in need of protection and those involved in crime or delinquency are addressed within an integrated, non-judicial, welfare-oriented framework—as a comparative reference, and examines possible avenues for institutional reform of Korea’s child protection and juvenile justice procedures. To this end, the study primarily employs doctrinal research, analyzing relevant statutes and regulations, statistical data, case law, and prior studies, while supplementing this analysis with qualitative research.
    The findings of this study indicate that Scotland’s Children’s Hearings System is significant in several respects. First, it guarantees children’s right to be heard not merely at a declaratory level but by codifying it as a general principle and through detailed procedural provisions, thereby ensuring its effective implementation throughout the proceedings. Children’s participation in the process is recognized as a right, and institutional support is provided—through child advocacy services, legal assistance, and child rights advocacy workers—to enable children to form, express, and communicate their views. Second, in contrast to the Korean juvenile justice system, the Scottish model adopts a welfare-oriented approach centered on local authorities rather than a response focused on criminal sanctions for children involved in crime or delinquency.
    By contrast, neither the Child Welfare Act nor the Juvenile Act in Korea defines children’s right to be heard as a general principle, nor do they establish an institutional structure that effectively guarantees children’s participation throughout the procedure. In addition, interventions following juvenile protective dispositions tend to focus on correcting the individual child’s behavior, while welfare-based interventions addressing the family and living environment are not institutionally secured. In particular, juvenile at risk of delinquency(status offender) are funneled into juvenile justice procedures despite having committed no criminal offense, whereas welfare interventions targeting the root causes of their behavior remain limited.
    Based on these observations, this article argues for explicitly codifying children’s right to be heard as a general principle in both the Child Welfare Act and the Juvenile Act, and for expanding support mechanisms that ensure children’s direct participation and the effective exercise of this right throughout child protection and juvenile justice procedures. Furthermore, to institutionalize welfare-based interventions for children subject to juvenile justice proceedings, the article proposes including such children within the category of looked after children under the Child Welfare Act, establishing notification provisions to enable integrated operation between juvenile justice and child protection procedures, and transferring responsibility for the execution of juvenile dispositions to local governments. In addition, it advances legislative alternatives that would abolish the provisions on status offenders and police referral under the Juvenile Act, and instead incorporate status offenders into the child welfare system for protection and care.
    Finally, it is hoped that further research and concrete discussions on institutional reform will build upon this study, so that the guarantee of children’s right to be heard and welfare-based interventions for children subject to juvenile justice can be realized in practice rather than remaining at the level of principle.

    본 논문은 스코틀랜드의 아동청문위원회 제도를 우리나라의 아동보호절차 및 소년보호절차와 비교·분석함으로써, 아동의 피청취권 보장과 범죄·비행소년에 대한 복지적 개입을 강화할 수 있는 제도적 방향을 모색하는 것을 목적으로 한다. 우리나라의 아동보호절차와 소년보호절차는 당사자인 아동의 의견이 충분히 청취·반영되지 못한 채 운영되어 왔으며, 아동복지법과 소년법에 따라 분절적으로 운영된 결과 범죄·비행소년에 대한 복지적 개입 역시 제한되어 왔다.
    이에 본 논문은 아동의 피청취권을 절차 전반에 걸쳐 보장하고, 보호대상아동과 범죄·비행소년을 비사법적·복지적 절차로 통합하여 다루는 스코틀랜드 아동청문위원회 제도를 비교법적 분석 대상으로 삼아, 우리나라의 아동보호절차와 소년보호절차에 대한 제도 개선 방안을 탐색한다. 이를 위하여 문헌연구를 중심으로 관련 법령과 규칙, 통계자료, 판례 및 선행연구를 분석하였으며, 이를 보완하기 위하여 질적 연구를 병행하였다.
    연구 결과, 스코틀랜드의 아동청문위원회 제도는 다음과 같은 점에서 의의를 지닌다. 첫째, 아동의 피청취권을 일반원칙과 구체적 절차 규정으로 명문화함으로써, 이를 절차 전반에 걸쳐 실질적으로 보장하고 있다는 점이다. 아동의 절차 참여를 권리로서 보장하고, 아동권리옹호인, 법률조력, 아동권리조력인 제도를 통해 아동이 자신의 의견을 형성·표현·전달할 수 있도록 제도적 지원을 제공하고 있다. 둘째, 범죄·비행소년에 대하여 형사적 제재 중심의 대응이 아니라 지방당국을 중심으로 한 복지적 개입을 실시하고 있다는 점에서 우리나라의 소년사법체계와 대비를 이룬다.
    반면, 우리나라의 아동복지법과 소년법은 아동의 피청취권을 일반원칙으로 규정하고 있지 않으며, 절차 전반에서 아동의 참여를 실질적으로 보장할 제도적 구조 역시 마련되어 있지 않다. 또한 소년보호처분은 소년 개인의 행위 교정에 초점을 두고 있어, 가족과 생활환경에 대한 복지적 개입은 제도적으로 담보되지 못하고 있다. 특히 우범소년의 경우, 범죄를 저지르지 않았음에도 불구하고 소년사법절차로 유입되는 반면, 비행의 근본 원인에 대한 복지적 개입은 제한적으로 이루어지고 있다.
    본 논문은 이러한 문제의식을 바탕으로, 아동복지법과 소년법에 아동의 피청취권을 일반원칙으로 명문화하고, 아동보호절차와 소년보호절차 전반에서 아동의 직접 참여와 피청취권 보장을 위한 조력 제도를 확대할 필요성을 제시한다. 나아가 보호소년에 대한 복지적 개입을 제도적으로 실현하기 위하여, 소년보호절차에 회부된 보호소년을 아동복지법상 보호대상아동으로 포섭하고, 소년보호절차와 아동보호절차가 연계되어 통합적으로 운영될 수 있도록 통지규정을 마련하며 보호처분의 집행 주체를 지방자치단체로 전환하는 개선 방안을 제안하였다. 아울러 소년법상 우범소년 규정과 통고 규정을 폐지하고, 우범소년을 아동복지체계로 편입하여 보호하는 입법적 대안도 함께 제시하였다.
    아동의 피청취권 보장과 보호소년에 대한 복지적 개입이 실질적으로 구현될 수 있도록 향후 본 연구를 토대로 보다 폭넓은 연구와 구체적인 제도 개선 논의가 이어지기를 기대한다.
